Child Born in the UK, has Tier1 but Parents switch to ILR

Post by mohami5 » Wed Mar 11, 2015 2:31 pm

I have a quistion related to registring child born in the UK with MN1. Is there a time limit after parients get ILR ?

I have been granted ILR this year, I have two children UK Born, I did not apply for their ILR. We went in person for the ILR visa and when the officer asked are you applying ILR for your children we told they are born in the UK and they were ok with it. ( as we can apply for child registration for BC)
We are Indian national so my kids had Tier 1 visa as my dependent. as we did travell to India to visit family.

The Tier 1 dependent visa runs out soon for both kids does it matter if it runs out ? as I have anyhow switched my category and got my ILR ?

Do I have to apply for child registration with in this time - The MN1 from says you can apply for children under 18 years old. ( my children are under 5 anyway)

Question1: Is the old Tier 1 dependent visa relevant to minor born in the UK after parent switch to ILR ? MN1 does not ask about any visa

Question2: if I apply via NCS will they ask me why I have not applied with in the Tier 1 visa validate date if chose to apply next month ?

My knowledge about this is
If child is born in the UK and both parents get ILR then the child is elibigle to be registered as British citizen directly.
You just have to apply for British passport for children once parents get ILR.
I have seen one of my friends applying for British Passport for the child based on his and his wife's ILR and the child being given one.

Senior members please correct me if I am wrong.

Thanks for the quick responce, So do you think we can directly apply for Passport without Registering the child as BC as both of us on ILR now ?
Please note we were on Tier 1 General when we had kids not ILR.
I heard that kids born after one of the parents has ILR qualifies for applying for passport directly?

Going back to my question, Do I need to apply for Registration before the Tire1 Dependent Visa for my son expires ?
as I have switched to ILR with my wife I though the old visa will be not relevant for my children as the main dependent has a new Visa now ?
and the main thing I need to know is can I wait and apply for registration is there a time limit due to the old Tier 1 visa which they use to hold do I have to apply with in the validity of the T1 Gernal visa.

Thanks for your help, I have submit the application through NCS.
It was very simple, they did not even check the old visa as my kids ware born in the UK.
Kids Birth Certificate as they are born in the UK.
anyone parents ILR BRP card, in my case I signed the declaration so they took my ILR BRP card. and took a photo copy of birth certs and my BRP.
They gone through the MN1 form and the payment card. checked the payment details and give us a receipt acknowledgement.
