my employer doing RLMT for me and they advertise Job on 2 different places. Also they planing to apply RCOS 02.04.2015. According to new changes (April 2015) All the salaries gone up. But my employer advertise under old SOC code salary. Is this going to be a problem whn they apply for RCOS, Please help

If the RLMT salary was exactly the minimum reqd SOC salary, then they will have to conduct RLMT again with the new salary. If the salary was above the SOC one, check if the increase in SOC salary is affecting you or not.

Thanks very much for ur reply. We advertised 25000 but according to new rules it has to be 28400,
just want to to
1. they published this on 27th feb but we advertised on 25th.

And my visa running out 30th April and if they advertised again i have to leave the country to due my visaexpire

i think the rule is that the employer has to assign the COS before 6th April for old rules to apply. If they cannot do it, they will have to conduct the RLMT again if the salary threshold has changed and its now lower than the minimum reqd.

Hi All,
I am currently on a T2 ICT Short Term Visa valid from 29-Dec-14 to 10-May-15, my CoS being valid from 12-Jan-15 to 11-Apr-15.
My actual assignment date would be from 1-Feb-15 to 4-Apr-15 (ending next week). Since my CoS is only for 3 months and the actual stay in UK is only 2 months, will this exception apply to me.
Actually I have got another job offer and would like to come back on ICT T2 General visa, after finishing this current assignment . Is that possible given the new changes in the rules?
Any help would be greatly appreciated!!

What matters is the period of engagement as recorded in the CoS (work start date to work end date). If this was 3 months or less you will be exempt from cooling-off

Hi,
Under new rules an anyone confirms how tobhandle below situation
Person on tier 2 ICT ,with dependents valid till 2016 is in UK.
If he has to change to a company in Uk
1. Can he get his Visa transfered from here ?I think this cannot be done as he is on ICT.
2.Assume if he goes back..can he come to UK by applying and getting a tier 2 general visa for a new company/CoS before 2016 from his base country (inspite of valid ict till 2016) , will this application be accepted or he can do thisbpost his visa expires in 2016.

12 month cooling off period is required.

Hi everyone can anyone guide me i entered uk on tier 2 general shortage occupation on oct 2013 my question is am I eligible to grant leave to remain as per the new rules

yes, you can extend your leave with a new CoS up to Oct 2019 (6 year cap) and you will be eligible for ILR in Oct 2018
