ILR or citizenship or dependant for my son's situation

Hi,

My son was born January 2013, while I had student visa and my wife also. I granted for ILR in July 2014 and wait for applying for my British citizenship this year July (12 months after received ILR) and my wife was still with student visa. We just have a newborn baby last couple weeks ago so my baby will automatically become British citizenship. However I want to ask about my son's case, what should I do with his situation and what is eligible for him to apply? (which is ILR of citizenship or dependant).

I am looking forward to any advice.

Where was your son born? In the UK or abroad?
my wife was still with student visa
Is your wife still on a student visa? Is this her own student visa or dependent of your previous student visa?

He was born in the UK and never leave the country since hes born

You can apply to register him as British on form MN1 under section 1(3) of the nationality. It is an entitlement to register as he was born here and you now have ILR. Current cost of application is £669 and this will go up to £749 on 6th April.

So to confirm :

1. Child born in 2013 - you need to register as British as he was born BEFORE you got ILR.
2. Child born recently - is automatically British as born AFTER you got ILR and you can apply directly for his British Passport.

He is yes (an entitlement), but you need to register him, that is why you can't apply for a passport directly as he was born before you got ILR.
