SET (O) + SET (M)? Self + Dep. applying for ILR at same time

Hi,
I am due to apply for ILR later this year and wondered if anyone on the forum can guide me:
I am currently a PBS Tier 1 (General) Migrant and my spouse is a dependent and qualifying period for ILR is 2 years. since we BOTH will qualify for ILR at the same time ( but since I will not be a already a settled person at the time of the application) I am unsure if :

1. I need to file a seperate SET (M) form for spouse, along with my SET (O) form ?
or
2. I could simply file ONE SET (O) form for BOTH and indicate my spouse as a dependent on it? (consequently pay both person's fees)

In short, should i need to file TWO i.e. SET(O) + SET(M) forms or ONE SET(O) or TWO SET(O) forms for myself + spouse.

Your wife does not qualify to use form SET(M).
ONE SET(O)
One form for both of you.

How long has your wife been in the UK and what is the start date of her visa?

Thanks for your reply. Wife has been in the UK since August 2012, but her visa was obtained before the rules changed for spouse requiring 5 years luckily. hence only 2 years as qualification time for her....I cant remember the exact date of her visa application but i am pretty sure it was before the rules changed.

Probably worth finding out the date. Or else too much to pay for.

You can do it in a single application form set O, watch out for fee increase in april 6th, incase you qualify around this time you can avoid the fee increase.

hello Senthil
just found out the date for her start of intial visa was 02 July 2012, the date of application i believe was around 24 June 2012 so she will indeed be qualifying with the 2 year rule..( & not the 5 years).. unfortunately i am not elligible for ILR until 3rd quarter of 2015, so i know we will be paying the new fees of £1500 a person... thanks for your reply!
