US green card

US green card

Hi

if a child is born in US, how long will it take for the parents to be classified as US citizen? , will they get a green card? what will be there status.

It depends entirely on if the parents are legally in the US. If they have no legal status in the US, having a child there does not automatically allow them to stay.

both tha parents were on J1 and J2 working visa,

she is working as a doctor and he is working as an IS Consultant.

they stayed in US for around 7 years.

on J1 and J2 respectively

please comment

I think to be able to qualify using the child, you would have to wait until such time when the child is 21 years so that you would be sponsored by the 'adult child' then. Anything else you would have to argue with G W Bush on Human Rights grounds which, I doubt you would succeed. :roll:

NB: I have edited my post to reflect the right age since I was not sure at the begining whether it was 18 or 21. Thanks Marco and Yanke Gal!

They have to wait until the child is 21, then (if the rules haven't changed) the child can petition for them to get an immigrant visa as immediate relatives. The process currently takes 6 months to a year.

Even if they are in the US legally, having a child there makes no difference to their immigration status (until the child turns 21).

The "J" visas are temporary visas, usually designed for medical or university research or similar such activities. Unusual for them to be renewed for so many years.

Can the parents not qualify for green cards ..? After so long in the country, the medical doctor should certainly be eligible :

Permanent residence for doctors

There are long delays right now, but it would be faster than waiting for the child to come of age. The other advice here is pretty much on: U.S. immigration law is designed to prevent people from having their child born in the U.S. to use as an "anchor baby" for their own immigration.
