Little advise plz if someone had same experience

HO refuse my EEA application and gave me right to appeal and serve a notice to my wife to leave the country in 30 days or lodge an appeal against the decision.
Me and my wife lodge an appeal,

Her is listed in mid of March 2015

And mine is listed in end of January 2015

What will happen if I win my hearing in January ? Does she still need to proceed her hearing ?

And if I'll win , will HO process my application towards RC or they will wait for my wife hearing ?

All depends on EEA nationals case,if EEA win the appeal and allowed to stay in the uk then non EEA may stay in the country if EEA national meet the requirements.

Sorry a bit loss here, so they are actually asking the EEA to leave the country :shock: . i Wonder what is the argument behind that...

Yes they are asking to EEA national ( my wife ) to leave the country or she can appeal against.

Well there is nothing special behind this argument

Here is timeline

Application 11 June 2013
Coa 14 June 2013
HO visited us at home 26 nov 2013 and found us at home with my brother in law as he live with us and asked question about our relationshion only one reason why I'm not going college ? I said I do not have funds to pay college as I'm not allowed to work so that's why we apply visa because we are married and have lot of expense ( as I know lot of people doing this just to get leave to remain but we have real relation and love each other ) so after one hour investigation they left

Application refused on 28 November

Lodge an appeal which was listed on 16 of July 2014 and gave the witness statements of parents in law and request to court for translater for them
HO withdraw on 15 of July one day before saying it was wrong decision

After one month we were invited for interview to Liverpool on 30 September
Ask about 100-120 questions from both of us and refuse application on spot with 7 wrong question
And kept me there and they said to my wife she has to leave country in 30 days or she can appeal against and she has no right to work in this country until further decision
They took me to detention centre and release me after 10 days

Now we both are on signing as we are a big criminal and waiting for court decision

Punishment for love in this country

Please advice me what will be the best my hearing is on 29 of January and my parent in law and brother in are coming to court with us as my brother in law living with us from first day

HO again visited us on 25 November 2014 and checked if we are still living together

2 visits and they found that you are living at the address and they are still playing game. I think you will be alright, just get yourself a good lawyer for the appeal and attend with your wife too.
I hope that GURU and knowledgeable people of this forum will give you some more advice.

i have very good solicitors as he fight good on last refusal and home office withdraw it from court

please pray form me my hearing is very near thanks

Yes Its advised to proceed to your wifes hearing . It wouldnt be that hard if you win your hearing , because at that point HO would have acknowledged the fact that it was not a sham marriage.

There is no much info on ur circumstance to enable good advice.
You said the eea has been in UK for 3years?
How does the eea exercise treaty rights?
When did U start this work or business

here you go my solicitor had call from court that they are not ready yet so hearing van not proceed .
they will issue a new date

yes she is here 3 years plus
she was working in photo printing , and now she has work restriction from home office so she is not working
i didnt get the last one about work or business

It has canceled from court yesterday and new date is in July

After lot of explanation to court by Email that we can not survive anymore this long ( till July ) as we both have restrictions from HO that we can not work. So finally they were agree to link with my wife hearing in mid of March.


Can any one help me what will happen there as it will be two hearing ( mine and my wife )

Can you please throw some light that how many times you had to convienced for early hearing..

please inform me that wither they convinced in just one email or we have to email them again and again ?

please help me


as me too same boat and hearing cancelled and shifted after 7 months

Well brother i dont have any reason

but want to email in case they accept...

as just want early hearing..already was waiting for hearing which took 7 months to come after refusal.. and again now extended for other 7 moths because of lack of court time..

they have dates but out of london and that i dont want to do as i have young kids..cant travel..

dont know what reason should i say to them ???
I just need to claim 10 years legal stay in appeal on additional grounds.. nothing esle. so that Appeal is allowed on additional grounds and change of circumstances//

Your case seems strange to me.. What nationality is your wife? does she commit crimes before your met each other? . The decision of rejecting your application seems strange and your wife have right to live and work in the UK as long as she is EEA national.

she is Hungrian , LOL she never commit any crime well may be this is crime in uk that we love each other and got married

read other members case many of them have same
shame on them those attempt fake marriages and play with real people life

I had hearing yesterday
Application sent june 2013
Refused november 2013
Appeal listed july 2014
One day before the hearing HO withdraw the hearing
Called for interview in September ( 96% answered were matched ) but they again refused
Appeal listed for march 2015 which HO adjourned
And new date was yesterday was 2nd june 2015

HO officer said to my wife to go out for while
She start asking me the question

then my wife was called in
and she answer 100% accurate as she speak with my family so she knew their names with spelling tooo
judge ask anymore question from anybody said no
He replied this very unusual that we give the decision on the spot but ill be allowing your appeal and will send written determination in up to four weeks
Court is end now
