Help with Tier 1 genera to ILR, 15 month qualifying period

Hi Guys

I need help with my application, my first application was before 6 April 2010 rule but my tire 1 visa started has follows;
First Application= 21/04/2010 – 21/04/2013
Second App. (Renewed) 21/04/2013 – 21/04/2015

I planed to apply with 12 month income within last 15 month i.e January 2014 – December 2014, all salary income. However, I have booked PEO appointment 28 days before 21/04/2015.
My main concern now is that my income in January 2014 was paid on 3/01/2014 but payslip was issued on 31/12/2013

1. 03/01/2014 (Payslip issued on 31/12/2013)
2. 02/02/2014
3. 15/03/2014
4. 14/04/2014
5. 13/05/2014
6. 15/06/2014
7. 15/07/2014
8. 15/08/2014
9. 15/09/2014
10. 15/10/2014
11. 15/11/2014
12. 15/12/2014

My question is should I stick to 02 Jan. 2014 – 15 Dec. 2014 or should drag it back to 30/12/2013 – 15/12/2014 ?,
Please remember I have to cover full 3 month before my appointment at PEO next week to fulfil 15 month period of time.

Your advise is needed guys!

The date on the payslip does not have to be the same as that of the salary payment. The income must pertain to the period claimed i.e. you cant claim the income of Nov-2013 as the income of Dec-2013 just because it was paid in Dec-2013.

No need to panic. When I was working in my first company I got paid on every 15th and that didn't change anything. My payslip always has the end date of the month. As long as your bank statement can back up your payslip you don;t have a problem.

look , if your appointment is say 24th of March, your income should start no earlier than 24th December 2013.

also, if you start at 24th December 2014 then you can claim to 23rd December 2014.

But to do that you need to be able to separate which income is earned before and after 23rd of December. In practice this is rarely possible.

The previous comment author is right. for salaried employment It is mostly about when income is earned, although for freelance and self-employment it can be more about when income is received.

the law unfortunately is written for Uk conditions, when salaried income is almost always paid in the same period when earned. But say if you are working all december 2013 and are paid on 31/12/2013, you cannot include it with an application made on 24/03/2015, because it is payment for the whole month and most of that mont is outside of the 15-month period.

So I cannot really answer your question without knowing what it actually says on that 31/12/13 payslip.
But I doubt it will work.

And no, you do not need to "cover the last three months". For all I care you could claim 24/12/2013 to 23/12/2014, or say 24/12/2013 to 01/12/2014.

@ sagareva, Decemebr 2013 pay slip was a felixible work within December period but salary pay fall in January 2014 category. although paylisp was issued on 31/12/2013 but income fall within my qualifying 12 month period. i.e, January - December 2014 or can I claim 26/12/2013 - 25/12/2014 (being that 26/12/2013 to pay day 03/01/2014 is on week gap).
