ILR/ Extention

Hi All,

I am due for ILR in 2 moths as a spouse of a settled person(two year rule applies) -got first visa before the new rule.

Few weeks down the line to getting ILR, my relationship is melting down hence a back up plan. I have a child who is already British and lives with us.

Any way out in case the unexpected happens??

I am employed and I support my family all document are up-to-date and no criminal records.

i think 2 month should NOT be hard to manage?
i am no expert you should get ILR based on your child being british

Provided that you can still prove that you are the spouse of a settled person, you should still get your ILR.

You are considered a spouse until the decree absolute of the divorce. That would easily be more than 2 months away.

The key thing is to ensure that you have the paperwork proving that you are the spouse (marriage certificate).

This is relevant to citizenship applications.

For ILR, the spouse applying and the settled/British spouse need to prove that the relationship/marriage is subsisting. Best advice to the OP would be to try and make things work out for the next few months at least.

The main issue here is, will your spouse support your application for ILR?

Is your spouse prepared to support you, or is your relationship subsisting.
