Dear brothers and Sisters
My Husband has send his Set (lr) and I want to send my FLR (M) with my 2 dependants came from Pakistan.
Note. I have 2 UK born child too
Got Questions
Q1.When my husband fill section 7A will we have to meet financial requirement for
a. Me and two Pakistan born child OR
b. Me and two Pakistan born and 2 UK born
Q2. If I don't apply now and once once my husband get ilr then use premium service
a. Fees + premium charge 400 because my 2 dependants are on same application form
b. Fees + premium charge 400 £ * 3=1200 for myself and 2 dependants.
Q3. I have done B1 Level 5 from Trinity college but FLR (M) required A1. I have heard a lot recently on this forum.
Q4. If I apply now and request to hold my case while my husband's case is decided
How should I fill when form asks
WHAT DATE YOUR SPONSOR OBTAINED SETTLEMENT

please reply and earn prayers

Hi All,
New to the forums. I am planning to apply for ILR *10 years in september. I need some advice on this as I am getting conflicting information.
Back ground.
entry clearance date:23/08/2005
Date of entry: 18th september 2005.
dependents: Wife, 2 kids (one born here in october 2014 and the other in india in 2011)

My tier 1 general Visa expires on Jan 21st 2016.

Can some one please update ehat my options are.
what if i don't get my ILR before visa expires.... i mean options for my dependents.
how about my son who was born here.is he eligible for applying for British passport if I get my ILR. Thanks.

G M wrote:I am still bit confused as i heard from many people that its 28 days before the issue date of the first visa. i think the applicants can apply 28 before the issue date if you come to UK within 90 days of the first visa issued. If entry clearance was made after 90 days of the first visa issued then ILR application must be submitted 28 days before the entry clearance date.
Hi GM,

There are two answers to your question. First on a definite one:
You can only apply 28 days before fulfillment of your qualifying period; qualifying period being 10 years.

Now, you may ask when does your qualifying period starts. Without getting too much into legal jargons, reading of Home Office webpage says this:
Your 10-year qualifying period starts from either:
  • when you arrived in the UK with a visa
  • when you were given permission to stay in the UK
Simply put, it means, it does not matter when you got your entry clearance and when you arrived, as your time starts from when you arrived. An alternate would have been, if somebody had arrived in the country on an invalid document and then got some form of legal stay and later got their "leave to remain", then from the date of issue of that "leave to remain" the 10 year start.
Second answer which includes some "may", but upto the caseworker.

The Home Office, guidance "Indefinite leave to remain: calculating continuous period in UK" (version 23 January 2014) states the following: (Link to guidance: https://www.gov.uk/government/uploads/s ... eriods.pdf)

The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. The period of delay will not be counted as an absence if it does not exceed 90 days. If the delay is more than 90 days, none of the period between entry clearance being issued and the applicant entering the UK can be included in the continuous period calculation.

If the absences are connected to other employment outside the UK, which demonstrates the UK employment is secondary, these are not permitted absences, and the continuous period requirement is broken.

Where an applicant’s continuous residence period includes time spent as a Tier 2 migrant or a work permit holder, annual leave includes a short holiday taken on conclusion of employment, where the applicant applied to work for a new employer within 60 days of the conclusion of the previous employment.
As you can see, the wordings in the guidance do not confirm a generalisation of this 90 days practice for all entry routes, but mentions "UK employment" in subsequent paragraph, leaving the decision at case worker's discretion.

Hi, taz123.
I suggest to call the HO and to check the address to which they sent your documents. We found that my daughter's documents were sent to the wrong address as the post code was the same, but the house number their computer automatically added to the system was our neighbours'. So we went to the neighbours to track their posts/letters and found the notification that the postman tried to deliver the documents but there were nobody in the flat.
Than we called to the HO again and explain the situation. They changed the address in their database, notify the post office. Waiting.

Sorry to hear it. Please go to this old address and ask the people renting it regarding the posts. We asked our nabours and they kindly allowed to look through all the posts keeping in the corridor.

I can't go n check bcoz its a business address in Covent garden London and they refused to take it Royal Mail due to send it back to HO but as there is no return to sender adress it. Might got. Back to delivery office in Belfast
HO just saying till we get received we can't do much about it and not telling me anything about decision
Very distressing

She might have to do the A1 because i saw a post on this forum last week when someone said they refused her wife because she submitted B1, but they gave her visa based on her private life.

All,

Looking at our spreadsheet, I'm seeing a big improvement in the processing time HO takes, as many people are getting their decision in 7-8 weeks these days; 5-6 weeks in some cases. It doesn't appear that they've all expedited their cases. I know each application is unique and the process time is only an indicative figure. But, if look back four or five months, HO took 14-18 weeks. So, I'm wondering is this a sign of geniuine improvement in the process time or is it quite normal the process is faster during this time of the year.

p.s. I'll be applying in mid-August. If the application process takes only 5-8 weeks, it would make massive difference to me personally.

Hi yask

Congrats buddy. I think you can write a letter and attach copy of your ILR and send it to Sheffield address or you can do it online there is a link on HO website return of docs follow the link it takes 20 working days I think. Other may shed some light on it.
