From the 6th April 2015, appeal rights are going to be severely curtailed for every applicant.

It would appear that EEA appeal were going to be affected, which would clearly had been unlawful, as body of caselaws from the CJEU and the Directives, indicates that there should be a right of remedy for these people.

It appears that the Amendment EEA Regulation 2015, appears to make it clear, that the Status Quo for EEA nationals and their family members will broadly remain the same. Then again It will be perplexing for me if is was not maintained.

I am happy to tell you my appeal has been allowed .. on 18 march ..
Today was the 14 day which ukba had to appeal to UP..tribunL.. but they did not.. i call court today.. 4.40 pm..

Does that mean.. i will my resident card in next few weeks.. eea 2 application..

i am page up.. sorry for LAST TIME.

Am i still in dangerous zone Can ukba stilll drag me to Uper tribunal Today was 14 day Which is Over now

Where do i stand now???

Judge made strong./postive decsion for me...

18 march we recived court determination.

Plz advise.. shall i invlove my local MP to tell ukba to grant me RC...

Hello,

I have one query (Sorry if this is not a right thread to ask question).

I and my partner's first tier tribunal appeal was due on 13 April 2015. Today my solicitor called me and said that my appeal has been cancelled due to lack of judges available :S

And now it might be postponed till October 2015. Is it really possible?

Tribunal already allocated us date then how could they change it?

And my partner does not have work right for past 2 years due to refusal+appeal time duration and now we have to wait 6 more months.

Please let me know if we can do something?

my solicitor said said there is no other option except waiting. Please if anyone can advice something. it would be much appreciated.

We had our appeal postponed 2 days befor last november till this feb but still could work even after our refusal notice
2011 Sep EEA1- Portugal
2011 Nov Wife arrived
2012 Jan EEA2 Issued to Wife
2013 Apr 1a issued on arrival at port spain
2013 Nov 1a issued after day trip france
2013 Dec EEA2 applied for
2014 Jan CoA with work 3 weeks
2014 Jan Passports returned

i got my passport woth 5 year visa

My wife and 6 month daughter are french national.
I got my 5 year permit on behalf of them. I am pakistani.

can my wife apply for housing benefits?? And how it will affect me when i apply for permant residency 2020

Plz advise

Hi samsungblack

If your wife working in the UK then yes she is eligible for benefits, but if she is not working then she is not. remember your PR is also based on her income I mean her working status. (she could be working for some employer or self employed . remember must check the minimum income per week to retain the status of worker).

In case she don't want to take benefits then in that case she need CSI (comprehensive sickness insurance ) to retain her right to reside status of self sufficient person in UK. In this case CSI need to be covering all the family members and you can not get any benefits in this case.
