Absences while self employed

Post by ChromaticMind » Fri Apr 03, 2015 2:10 am

Hi guys,

I'm a self employed sole trader freelancer applying for ILR in May 2015 via the Tier 1 General route.

I've read online that I need to account for all my absences in the last 5 years and have also found some useful templates for the same on this forum (thanks!).

My questions to you guys are:

1 - Do I have to account for every leave from the UK (work, leisure, etc) even if I've gone for less than 180 days in any of the five 12 month periods?

2 - If so, then what proof do I need to submit for work related trips as I don't have any pay slips as I generate invoices and get paid against them.

3 - For holiday leave is there any proof to be given? Example I took three months off to go back home to India for my wedding. If so then what exactly?

Thanks in advance for your help!

Best,
cM

If your total absences are less than 180 days in 5 years, you need not show any proof. Just mention in the cover letter.

Perhaps you misunderstood me.

I've had a total of 250 days of absence in last five years but it's never gone over 180 days in any given 12 year period.

I'm really confused regarding what do I need to do!

I will leave this to seniors as you should not be out of UK for more than 180 days in total in 5 years.

as per below link

https://www.gov.uk/government/uploads/s ... eriods.pdf

No more than 180 whole days absence are allowed in any of the five, four, three or two consecutive 12 month periods, depending on the category, preceding the date of the application for indefinite leave to remain (ILR).

Its very simple. You need to prove while during absences your self employed UK business was active.

Right so I think I'm OK as I've had way less than 180 days in any consecutive 12 month period.

I've been self employed since my Post Study Work visa until present so thats a good thing and keeps stuff uncomplicated.

Lastly, I guess the only thing I need is a letter detailing all the absences with reasons (primarily holiday) on a paper with my sole trade letter head right?

Am I missing anything else?

Thanks for your help guys!
