What if valid until date doesn't match work end date on COS?

What if valid until date doesn't match work end date on COS?

Hello,

I recently applied for Tier 2 General visa on 1st April 2015 which was approved on the same date via premium service.
The work end date on COS specified by my employer is 31 March 2020. I applied it for over 3 years as you can see by the end date specified in COS.

I've received my biometric card today and it says the date of expiry is 17/05/2019.

I'm confused whether is it an error or done on purpose by Home Office!

- is this case really eligible for admin review?


However, I'm on Tier 2 G visa since October 2013 and even if I stay happy with this expiry date above, I can still apply for ILR (5 yrs) in near future. But I'd like to know if I can do anything for this.

What was the start date of your first Tier 2 General Visa?

On Tier 2 visa the maximum stay is capped for 6 years unless it was allocated before April 2011. Though after 5 years you can apply for ILR and stay as long as you want. But if for some reason you dont go for ILR you can not stay on Tier 2 G Visa for more than 6 years.

If your first visa was allocated in May 2013 then this might be the reason you have got the end date on visa for May 2019.

Hi ravi_ei,

As far as I remember, I got my first Tier 2 General in Oct 2013. So, is this something that I can report to them or should I just leave it as I can still cover my 5 years to fulfil conditions for ILR ?

I am not sure why they gave you around 6 months less in your visa. I am not sure what can be done about it. Your employer can ask on sponsorship help line maybe. I would wait for some senior member to comment on this.

But the bright side is that you can apply for ILR after 5 years which should be october 2018. Just make sure you fulfill the salary requirements at that time and have no unspent criminal record from oct 2016.

Its close to 10 months less based on the work end date specified by my employer. I'll ask my employer to call them tomorrow and ask about this issue. I'm quite relaxed about the fulfilment of the conditions for ILR as I've got the 5 years of stay & salary requirements covered now.

The letter that came today with biometric card says that: if you find a mistake in card, complete the on-line form at http://www.gov.uk/biometric-residence-permits However, I'm not able to find any form via this link. Are you aware of such online form?

look in your passport or BRP for the exact date.

Hi Manci,

I'll have to search for the letter that came with old biometric card. I don't have that card anymore as it was taken by home office. However, I'm sure about the month and year.

Should I tell home office that I'm not happy with the amount of leave given based on the work end date specified by my employer in COS?

mistakes can be reported by email, see the link you quoted

Now its clear. Your first Tier 2 General was allocated on 17/05/2013. So your stay on Tier 2 General will be counted from 17/05/2013 + 6 years which comes to 17/05/2019. Maximum duration of Tier 2 General is 6 years irrespective of the change of employer.

But as I said before you can apply for ILR after you complete 5 years on Tier 2 General which in your case is 17/05/2018. so you can apply ILR from 20th April 2018 onwards ( 28 days before 5 years are completed on Tier 2 General ).

Yeah, you are right. I found my mistake of thinking oct 2013 for my first Tier 2 G visa. Yesterday, when I got all my documents I then realised this mistake and based on your previous post, I got to know the reason.
