SET O 4/2015 - 12 G

Post by chaitumkr » Sun Apr 12, 2015 9:46 pm

Hi Everyone,

I am Tier 1 G applicant Ltd Company Director. In the new SET O form under section 12G ,Which one to select ?

12G Highly skilled migrant
If you are applying for indefinite leave to remain on completing five years’ continuous stay in the UK under the Highly skilled migrant programme (HSMP) and other appropriate categories, in addition to the relevant documents in 11A, you must provide the following:

1) If you are employed, document(s) showing your economic activity and your personal earnings during your stay in the UK.
2) If you are self-employed, you should provide evidence of the progress of the business
3) If you were given leave in other categories leading to settlement before being granted permission to stay under HSMP and would like this stay to be taken into consideration in your application for indefinite leave to remain, you should provide details of the categories involved and the periods spent in each of them.

And which documents we need to submit. Its all very confusing and there are no guidance notes.

Regards

Shouldn't you be in category under 12L as your visa was granted on 14 May 2010 ?

If details in this post are yours, then you should complete 12 L. i.e. If you had tier 1 general migrant visa.
For 40 days absence, no evidence is needed but mention your out of UK dates in the application and say personal travel in the cover letter.

Hi akan, request you to take a second opinion on this.

c95tdg replied only for your statement (and he is correct in doing so). c95tdg did not say that 12 L applies only to mixture visas.

The way I read it, 12L is not exclusive to mixture of visas but is applicable to Tier 1 General Migrant on its own as well.. There are 2 check boxes in this section and the 2nd check box is applicable to mixture visas. So if we have only Tier 1 visa, then leave the 2nd check box blank or you can submit your docs of initial entry clearance prior to moving to UK if you still have them (but not necessary)
I have been through the application again, and no other option fits in for exclusive Tier 1 General Migrant Visa.

In SET O version 10/2014, this section was 11L; and I am on Tier 1 General Visa, and I checked 11L both boxes and submitted by docs of initial entry clearance of 2010 (in SET O 10/2015, the same question is moved to section 12L). My application was successful..

That's correct.

My ILR was granted just over 2 years ago, the SET(O) form numbering and sections have somewhat changed over the years, however the main questions remain the same. I applied as a T1G migrant, who previously had LTR as a WP holder, so that second checkbox applied to me. But in the OP's case here it does not.

Hi Krishna,

I need some help regarding a similar situation. I have posted on the forum but no one is replying.
I had received HSMP Approval Letter in July 2008 while I was in India and then I got Tier 1 General Visa on 15 Feb 2009 based on the HSMP Approval letter.

I moved to UK in 9th Oct 2009 and now I'm going to apply for ILR.

I'm not sure which section to fill in SET(O) Section 12. 12G Highly Skilled Migrant or 12L Tier1 General ?

Please help.

regards
Keyur
