Traffic Offence Points on Driving Licence.

Post by aakuij » Sun Apr 12, 2015 10:59 pm

Hi All,

I have two questions;

Question 1. I have recently got 3 points on my driving licence for use of mobile while being on driving seat though car was stationary but on road. Anyway I was given a fixed penalty offence (instead of warning considering I wasn't a risk on the road :( ) and offence code is 324001 see below the details;

Code - CU80,
Offence - Breach of requirements as to control of the vehicle, mobile telephone etc
Penalty Point - 3.

I am due for naturalisation in the last week of May 2015 and the above specified point were given to me in April 15.

I would like to know if can/will impact citizenship application?

Question 2 - I will complete 1 year of my Indefinite leave to remain on 21st May but 6 years of my stay in the UK would be completed on 12th June, so my question is that Am I eligible for citizenship from 22nd May or I need to wait till 13th June 2015?

Thanks,
Aakuij

Summons by court FPN : wait 3 years before apply
By Police, 2 or more FPNs: wait 1 year before apply
By Police 1 FPN: Should not be a issue (except drunk driving, Over speeding & Mobile phone use, based on new good character requirements by HO)

An FPN for drink driving? I don't think so!

If you have a conviction, non-custodial, for a traffic offence you should wait three years and declare the conviction. Therefore, Amristar you should be ok.

I just found the below information on home office document "Annex D: the good character requirement" this gives interpretation to me that A Fixed Penalty Notice adhered in time should not make any impact, please share your valuable thoughts!

3.2 Fixed Penalty Notices, Penalty Charge Notices & Penalty Notices for Disorder

Fixed Penalty Notices, Penalty Charge Notices and Penalty Notices for Disorder are
imposed by the Police or other authorised enforcement officers for traffic rule
violations, environmental and civil violations. It is a way of the criminal justice system
disposing of fairly minor offences without the need for a person to attend court.
Receiving one does not form part of a person’s criminal record as there is no
admission of guilt.
The decision maker will not consider these unless the person has:
a. failed to pay and there were criminal proceedings as a result; or
b. received numerous fixed penalty notices which would suggest a pattern of
behaviour that calls into question their character.
Where a fixed penalty notice or fiscal fine has been referred to a court due to non-
payment or the notice has been unsuccessfully challenged by the person in court,
the decision maker will consider this as a conviction and assessed in line with the
new sentence imposed.
Where b. applies, the decision maker will consider the factors listed at section 3.8 –
Considering Cumulative, Non-Custodial Sentences.
Further information on Penalty Notices for Disorder is available on the Ministry of
Justice website: http://www.justice.gov.uk/downloads/ooc ... e-oocd.pdf

Hi Amritsar Singh,

I am also having problem with TV license court fine, Could be you please guide me if you have some details as I need to go for visa extension by next month and below is my issue.

Hi

I have received Summon from Magistrate Court for not having TV license on Dec 2014, Meanwhile I have moved my property and not aware of the summon till February 2015, Later I came to know from my landlord about the letter and I have contacted the Court and appeared with plead for guilty and agreed to pay the fine and the fine was £260, I have cleared the bill within a week and received confirmation letter for cleared the due ontime.

I am going for Tier2 visa extension by June, I have 2 clarifications as below.

1. Do I need to mention about court fine in my extension application under Civil Penalty (F3)section or Criminal conviction(F1) section

F3. Do you have any civil judgments against you or any civil penalty under the UK
Immigration Acts?

F1. Have you been convicted of any criminal offence in the UK or any other country?

2. If yes, Will my application get refused although, I have paid everything in full the very moment?

I request please consider my above queries and respond to me as soon as possible.

thanks
Ragu
