ILR for Tier 1 General dependent

ILR for Tier 1 General dependent

Hi,

I'll be eligible for ILR on May/2016 as a Tier 1 General. This is the situation for my wife.

1. My wife has come to UK in Tier 2 ICT in Apr/2011.
2. She became my dependant as Tier 1 Dependant by applying from India in Feb/2013 (04/Feb/2013 - Aug/2015).Her Tier 2 visa was valid,when she applied for Tier 1 dependant.
3. 2nd Tier 1 Dependant Extension with me in Jul/2014 (Valid till Jul/2017)

I would like to know whether she would eligible in May/2016 to apply for ILR under 5 year route (2 years in Tier 2 + 3 Years in Tier 1 dependant)?

Or she has to be in UK solely as Tier 1 dependant for 5 years (as she has got her dependant visa in Feb/2013).

Any help or pointer would be really helpful.

not scientific, but my first instinct says no. i think she needs 5 years as a post-2012 pbs dependant.

Thanks. I was thinking so. Then I've read in some forum that if you have switched to Tier 1 dependant while you have a Tier 2 visa validity then , the combine 5 year time spent in UK will count. Not sure what is the authenticity of that. If at all then it will save us some money :).

She cannot combine her time at Tier 2 main and Tier 1 dep. She will need 5 years as a Tier 1 dependent to qualify for ILR.

She would only be able to use the different combinations for ILR based on 10 years long residence.
