Post by SJ30 » Tue Apr 14, 2015 10:59 pm

Dear friends,

Can one of the experts advise on the below query please?

Background: Entered UK in Jan 2010 on Tier 2 (ICT).

There was a break of 218 days continuously [11-May-2013 to 15-Dec-2013] which can split across 2 years will not be more than 180 days as below if I apply in August 2015. Current visa validity is till Feb, 2016.

Year 5 11-Aug-15 12-Aug-14 14
Year 4 11-Aug-14 12-Aug-13 125
Year 3 11-Aug-13 12-Aug-12 92
Year 2 11-Aug-12 12-Aug-11 22
Year 1 11-Aug-11 12-Aug-10 31

Total Absence : 285

All other absence were on Paid annual leave and was short.

During the long absence I was working for the same employer from the off-shore.

I want to know am I eligible for the ILR? If yes what all documents I need ?

Any help will be deeply appreciated!

Regards,
Suk

If I would have applied in Jan then gap in a single year would be more the 180 days. As I understand continuous period is counted backwards form your application date. Please let me know if that is not correct.

You may find the following threads useful to establish whether the breaks you have would be acceptable & what supporting documents to provide to support these.

Please read the SET(O) form & guidance for requirements.
