compassionate reason ILR process.

Hi,

I need a clarification for my ILR application.

I have 190 days gap in one annual year in my five years split and during this period my baby boy was born. It was a c-section for my wife. I was working for the same customer from my home country through the same employer. Also I have utilized my 24 UK Annual Leaves in this period for which I paid in UK.

will this 10+ days considered as compelling or compassionate reason for my ILR process.

I will appreciate your response on this matter.

It might help if you show the 5 x 12 months cycles and what your absences are per year.

Maternity is not considered compassionate and compelling in my opinion, unless there was a major problem with the birth etc. but c-section recovery is generally only 6 weeks.

21-May-2012 - 21-May-2013 (In this year only I have 190 days gap in one year and in that 24 days are UK paid leaves outside UK. The remaining days I spent in India for the same Employer to work for the same customer from there. I went back to India on 12-Nov-2012 (Got paid in UK untill 06-Dec-2012 through the UK Annual Leaves) and came back on 23-Jun-2013, My kid was born on 10-May-2013.)
21-May-2011 - 21-May-2012
21-May-2010 - 21-May-2011 (176 Days Gap in offshore, this is also connected to same Employer/ Employment, No annual leaves)

Let me know if any further info needed.
