Does divorce means losing my child?

Post by philemon_bodiba » Wed Oct 03, 2007 1:55 pm

Hi!

I hold a Residence Card. I am a South African male currently married to an EEA national for more that a year now and, we have a 9 months old baby.

My wife wants a divorce. If we divorce does this mean I will have to leave the UK and have no access to the child?

Looking forward for your reply.

Thanks
Pa

You have a number of choices. You should see if you can apply for leave to remain under the EEA Rights of Residence. If that doesn't work, you can apply for leave for access to the child, although this may result in you losing the right to work here. You can also see if there are any other categories you are eligible for.
