Reg HSMP Indefinite Extensioin after 4 years

Post by shintu » Fri Nov 26, 2004 4:02 pm

Hi,
I have a very important question regarding HSMP Extension.

HSMP_Guidance_final_mar04.pdf says -->

=============================================

26.5 Q: How long can I stay in the UK if I enter as a skilled migrant?
A: You will initially be given 12 months stay. If you want to remain in the UK under the HSMP, you should apply for an extension of your stay in the last month before the expiry of your permission to stay in the UK. For further information, please see “Extension of stay in the United Kingdom” section. You will be able to amalgamate leave in other categories that lead to settlement for example, please see “Extension of stay in the United Kingdom section.” towards the end of that period you can apply to remain in the same capacity for a further period of up to three years. After four years in the UK as a highly skilled migrant you can apply for settlement. The main criteria for settlement will be that you have spent a continuous period of four years in the UK (except for trips abroad of three months or less, totalling less than six months in the four year period) in a category leading to settlement and that you continue to be economically active in the UK as a highly skilled migrant.

==============================================

From this I could interpret, one can stay atmost 3 months outside UK at one time.

I would appreciate if you could email me what shall
happen on completion of 4 years period, given that, I
had spend more than 6 months outside UK.
[Though
1. employed & getting payed in UK
2. paying my taxes in UK
3. Taking a few trips of 3 month or less during that period.

Will I be granted further indefinite extension ?
Will I be granted PR ?
Or what should I do if this happens ? [which is most
likely given the nature of work I am involved in,
which shall require me to travel outside UK].

Best regards
Ashish

Ashish, I have heard about people who have been granted their ILR in spite of them being outside the UK for longer than the prescribed periods. They did however have to wait and additional year before they received a passport. Apparently the HO told him that he had to remain in the UK for 275 days in the last year to be granted a British passport, which he also received in the end.

Hi,
Any body else would like to share their views on this issue ?
I am still unclear.

As of "EJ"'s reply, the people whom you wrote about were on HSMP ?
I have heard about Work Permit getting extended, not too sure about HSMP.

Did any body had any communication with Home Office in this regard?

I would appreciate replies.

Cheers
