Request for Reconsideration

I applied for my wife FLR (M) but HO refused it and grant her visa under Family route 10 years eligibility for settlement. I request HO for the reconsideration.

I received a letter from HO few days ago stating as i requested for reconsideration for granting visa as a spouse please return the current BRP by 03 Mar 2015.

The problem is me and my wife are on holidays and will be returning to UK in May 2015. So i am not sure what to do either return the BRP from back home or after returning to UK send them the BRP.

Need advice plzz.

Well the 3rd March is today, so you have missed that opportunity.

Also, you can't send it from where you are abroad. How will she re-enter the UK if she doesn't have a BRP.

Want to know by asking the BRP means they accepted my Reconsideration request?? Secondly we will be returning to UK in May 2015 can i still contact them and send them BRP ?

My wife will be granted limited leave to remain under Paragraph 284 of the immigration rules, i want to know after getting the visa will she will be eligible to to apply for SET (M).

My wife came in Jan 2012 as Tier 1 dependent and applied for FLR (M) in March 2015. As per my understanding old rules applies on her.

Highly appreciate the advice ???

Did you receive your ILR on the basis of 10 years long residence?

If she has been granted a spouse visa on FLR(M) then she has to wait another 5 years in this category since the rules on transitional arrangements changed in April 2014 and she cannot amalgamate the time she has spent in the UK on pbs dep.

Just want to add that i applied FLR (M) for my wife before the rules changed in April 2014. I applied in march 2014. Still she has to wait five years or comes under the old rules ???

I received a letter from HO few days ago requesting to send my wife BRP to be granted limited leave to remain under Paragraph 284 of the immigration rules ( mentioned in the letter received from HO ).

So the visa is not granted yet as my wife is still back home. I informed the HO as soon my wife will be back she will send her BRP.

What visa is your wife currently on?

Hopefully she won't have a problem re-entering the UK with her current BRP.

Until you can let us know what the new visa duration is, I can't really say anything. Perhaps Amber can advise when next online.
