I have 1 yr old who does not live with me. My visa ran out 4 years ago so am illegal. My baby mother will not consent to getting passport so I can use it in application. Can I go about receiving it myself? Thx

you don't need your child's passport to get your residence renewed .

first can i ask you these questions :

-were u and your child's mother married ?
-does your name appear on your child's birth certificate ?
-do you have visitations/ Access order from the court to see your child?
-are you paying any maintenance to the mother of your child for the upkeep?

-are you currently employed ?

if your answers to most of those questions is yes , then no need for your child to have a passport ,

can you answer the above questions in order for people here to be able to help /advise you as to what is the best course of action to take in order to legalise your situation .

Hi. No not employed. We weren't married. Yes I'm on birth cert. There is an access order yes and no I don't pay maintenance.

are you exercising your right to see your child ? based on the access order ?

was there a maintenance order against you but you are not paying , or the mother of your child did not apply for one ?

if yes that means you can demonstrate to the Department of justice that you are deeply involved in your child's life .

your situation can be resolved it is not that much difficult , but may take time
