ILR under 10 years long residency and Human Rights 1998

ILR under 10 years long residency and Human Rights 1998

Hi,

Since its already in news that Torry governemnt is very keen to remove the bill of Human Rights 1998 as soon as possible.

Will it effect in anyway to applicants who are waiting for there 10 years to complete?

I will complete my 10 years in next year Sep 16.

Hi Mate,

They might have plans, but until it officially announce no one know. They might scrap it like they did PSW & tier 1. They might give a timeline.

Its very early to make any judgements.

im on the same boat.ILR due aug next year dont know what will going to happen.Hope they will give the time line as they did it with psw and tier 1 general.

It is still early days regarding scraping human rights act 1998.

Last coalition government set up a committee to bring British bills of rights but failed to come up for new rules n then rejected by Lib dem therefore it would be a while to bring a new act/rules so expect it in nxt 6 - 12 months for initial draft.

Do not conflate the two.

The 10 year long residency route is a part of the Immigration Rules and is not directly affected by the repeal of the Human Rights Act. If anything, it is far simpler to remove by a simple change of the Rules by Statutory Instrument that can be implemented in 40 days.

What repeal of the Human Rights Act will primarily affect is the ability of people to appeal to the European Court of Human Rights in Strasbourg. It is fairly exceptional for immigration matters to be appealed to the ECHR and so I do not believe that there will be a direct impact on the immigration rules.

There almost certainly will be a hardening of the Immigration Rules in their own, but that has nothing to do with the repeal of the Human Rights Act.

Thanks All for your input. Yes I agree with you Simon that Human rights act has nothing to do with the 10 years long residency.However we can only hope that they do not scrap the LR route.

Hi There !
I am new here ! My queries are I am short of 3 months from 10 years long residency application so how can I cover the gap or by making what kind of applications I can buy more time to reach near 10 years ! Can I still apply 28 days before 10 years ? please advise.
