VISA for a child born in UK

Hello friends,

Please suggest me on the visa that I have to apply for my child who born in UK

My self- British Citizen
My Wife - ILR Visa ( Valid till 2023)
My Child - Born in UK , Registered as Indian Citizen and we received his new Indian passport.

Please suggest which type of VISA I have to apply for my child.

Was child born after you became British and your wife got ILR?

Hi,

Yes our Child born after I became British Citizen and My wife on ILR.

Then the child is automatically British and does not require a visa.

He was eligible the day he was born. You could have applied for his passport. I think you will now have to fill in form MN(1) and register him as British National.

Hi,

Thanks , but as I mentioned before we opted for INDIAN Citizenship and also received his indian passport.

With his indian passport we can take him away from UK but to come back he need a VISA. I want to know which visa I have to apply for.

Why not apply for his British Passport and go to India on a visa rather than the other way round ?

Nonsense, the child is still British as was born in the UK to settled parents (British and ILR). OP can still apply directly for child's British Passport.

You could apply for his British passport and then apply for OCI. Alternatively, you might be able to apply for a Certificate of Entitlement.

I know India do not have dual citizenship but I think your child can have both nationality means keep Indian passport and have British passport too.

I don't have links right now but may post later if figured out. I was in same dilemma of taking Indian or British nationality for my kid and during my research I read Indian Citizenship Act which has section for minor to have both nationality and keep one at being major.
If you discuss your case with Indian citizenship expert your case you probably figured out more.
