TIER 2 General - Dependent doubts

Post by reonred » Tue May 19, 2015 3:45 am

Hi Gurus,

I currently work in India.
I have got an offer from UK based company and they have issued COS for me. Actucally they are supporting the VISA formalities for me. However for my dependent's Visa I would need to do it by myself from India. So do I need to Register again in 'https://www.visa4uk.fco.gov.uk/account/register' and then apply for them separately? If that is the case where to give the reference of my Registration ID in their forms. Please suggest.

Thanks,
RR.

I am actually on the same boat as you. My company in the UK has applied for my visa and I have to do my dependents visa where i reside which is in Dubai. I also would like to know when should I apply for my dependents visa? Is it once I get my UK visa or can i do this while my visa is still under process?

Any help is much appreciated.

the company cannot apply for your visa, you have to apply yourself. Equally, the dependants must apply in their own names.
If the company certified maintenance for you this will also cover your dependants but only provided they apply for entry clearance the same time as you, if they apply separately they have to show maintenance themselves

Thanks,
RR.

My company in the UK used an immigration specialist to process sponsorship license, cos etc. This specialist is also applying for my visa. They have given me the date for my interview which is next week. So i don't understand what you mean by only I can apply for my visa? Once i get my visa i plan to apply for my dependents visa as the specialist is charging a lot approximately gbp 500 per application for their services.

the company's immigration advisor may have helped completing your online application and to arrange the interview but it is you who is making the application and you will be asked to sign papers.

it is the dependant who has to apply for his/her visa, not you

Ok. Thanks for the information. However when the dependant apply for the VISa, then they might need to mention something about the main applicant's ID or Visa Reference ID in their application right? could you please tell me what and where exactly they need to mention.

Is it possible to apply for Tier-2 general application for dependant along with my application?
For maintainance of funds for dependant what evidence needs to be submitted. India bank account statement is sufficient? or UK bank account details needs to be submitted? please confirm.

In my COS 'Tick to confirm the sponsor certifies maintainancefor the migrant' is mentioned as 'Y'. So is it OK to use the same for dependants maintainance also or do I need to provide India Bank statements showing a money equivalent to 630 pounds in my account for the period of 90 days?

The tick in your CoS also covers your dependants but only if they apply at the same time as you - if this is the case no documents are needed for maintenance either for you or for the dependants

Hi Manci,
Thanks for the information. I have few more queries.
I have applied for my Visa yesterday. My wife's application is still pending.I will be applying it by next week. Do I need to wait till I get my Visa before applying for my Wife's Visa? or can I proceed applying it before I get my visa?

Regarding maintainance, My wife is travelling with me. So do I need to produce bank statements? or the CoS with Maintaianence is sufficient?

Regards,
RR

Dependant Visa Doubts

Post by reonred » Wed Jun 24, 2015 7:22 am

Hi Gurus,

Do I need to provide any points based calculation for Dependant Visa? I am submitting marriage certificate, Indian Bank Statements (as I have not yet started working in UK, I do not have bank statements. I will be travelling with my wife) and VISA application. Hope these documents will be fine. Please suggest.

Also She was refused to give tourist visa by Germany. Do I need to submit refusal document also? please suggest.

I have received my VISA which is valid for one month. I guess the BRP which I will be collecting will be having all 3 years validity in it. Please correct me if I am wrong.

Thanks,
RR

The application form asks about any refusal instance. Do mention the details in there. It'll be good to attach a copy of the document. This will show that you are honest in your application.

TIER 2 Dependent query

Post by reonred » Wed Jun 24, 2015 7:31 pm

Hi Gurus,

Once German consulate was refused to give Tourist Visa to my dependent because of following reasons.
1) The Information submitted regarding the justification for the purpose and conditions of the intended stay was not reliable.
2) Your Intention to leave the territory of the member states before the expiry of the Visa could not be ascertained

Is this a serious concern that can reject my dependent's TIER Visa?
What can I provide or how can I give a correct answer for this. because this happened due to She was not able to answer their queries properly and she was refused Visa. Please suggest.

Thanks,
RR.

Dependant BRP - Not Required???

Post by reonred » Thu Aug 13, 2015 10:19 am

Hi All,

I have applied for TIER 2 General visa for myself and my wife from India. We both got the visa for 30 days and now we travelled and landed in UK. Yesterday I went to postoffice to collect BRPs for both of us. Only my BRP was with postoffice where as her BRP was missing. so I sent a mail to BRPCollections team saying that it is been missing in postoffice. They have replied saying that my wife does not need a BRP. But I am not sure where I can find validity of 3 years for her VISA. could you please suggest.

Thanks,
RR

I sent mails to BRPColection team, they are saying as the initial visa is for 50 days instead of 30 days, there will not be any BRP for this. And I wonder then how she will be allowed to stay after initial Visa which is valid till 19.08.2015.
I am confused now on what to do. Do I need to apply for a new visa again from UK or Do I need to send my wife to India and ask her to apply for new Visa. Please suggest.

Ask them why has your wife been issued 50 days leave when you have been granted leave for X years, and why they think your wife does not need a BRP when she has entered the UK as a PBS dependant.

What dates are mentioned on your wife's visa?

They are being ridiculous. Her leave should be granted in-line yours (319D).

Hi Guru,

Thanks for the reply.
My Visa start date is 20.07.2015 and end date 19.08.2015 where as My wife's visa start date is 29.06.2015 and end date is 19.08.2015. Which means Depedant (she) was granted Visa before main applicant's (my) start date, which is not correct.

Today morning I called entry clearance guys and asked them what has happened exactly. they said like it is a mistake from their side and they escalated this issue. As the Visa end date is approaching I asked them that, does my depedant needs to leave the country, then they told me to wait until I hear from them. So hopefully issue should get resolved soon. Please suggest me if anything I can do in the meantime. They are charging £1.37 per minute for the call. I had to be in the call for almost 40minutes.

It looks like the BRPColection team compounded the ECO's error, by not exercising common sense.
