Tier 2 ICT Established staff & Tier 2 General - ILR

Hi,

I'm holding Tier 2 ICT Established staff issued in 2011 for 3 years and extended till 2016.

I've continuous stay history under Tier ICT Established staff category for 3 years till now.

If I switch to Tier 2 General now in UK and stay for 2 more years, Can I apply for ILR after completing 5 years(3 years on ICT Established staff and 2 years on Tier 2 General) continuous stay as a whole?

No. Since your Tier 2 ICT was issued in 2011 those years won't be counted towards ILR. You will have to complete 5 years in Tier 2 General to be eligible for ILR.

You would need to live/work in this country for 5 years on Tier2 General. You cannot combine/count Tier 2 ICT as it was after April6.2010.

The government had changed the rules and said that people coming on Tier 2ICT after April'2010 would not be eligible for ILR and you cannot combine Tier 2 ICT (if you got this visa after 6th April 2010) with other visa category like Tier 2 General or Tier 1 and make up 5 years.

if you switch to Tier 2 General, you will have to start counting after that. Hope it is clear ..
