Will tomorrows Immigration bill effect applications ?

Post by Michael1988 » Tue May 26, 2015 2:38 pm

Hi
To my knowledge tomorrow the government will be announcing a new immigration bill.

Is it likely to effect people about to submit an application?

Will the changes take immediate effect?

Thank you

There is no immigration bill yet. It is simply the queens speech, Where the government sets out its plans.

Proposed bill.

It does not become law until it has gone through the houses of parliament .

Tomorrow the Queen will read out the speech written by the government about the laws that it hopes to introduce in the coming year.

Government lawyers will then write what they think the law should be. At this stage, it is called a bill. Ministers will then introduce the bill into one of the two Houses of Parliament. When the actual wording of the law is presented to Parliament, it will be listed here.

That House discusses the bill thrice. It then goes to the other House for another three readings. At any point here, the House can change the law. Finally, when it has been through both Houses and both have agreed on all the language in the bill, the Queen gives Royal Assent on the advice of the government and makes it law.

You can see that it is not an overnight process. It typically takes about a year. I would expect the law to be in place by April next year, when changes to immigration rules traditionally come into force.

Precisely . 1 years is a good estimate if things go through smoothly .
If not it could take a significantly longer period .

Nothing has even been drafted yet.

A positive news is, the human rights act is not being abolished in todays speech... So a bit of relief for some

Having seen the Queen's Speech, I think there is a chance that the Immigration Bill may actually make its way through Parliament quite quickly (still looking at Jan-Feb at the earliest), compared to the other legislation.

They would not want to spend too much time on immigration, where most parties are in agreement (what feasible argument is there for not confiscating the wages of illegal workers) and would rather debate the EU Referendum and devolution to Scotland, Wales and NI with EVEL in the Commons.

Which begs an interesting question; could we end up having different immigration policies in the different countries of the United Kingdom? Quebec already runs a separate immigration system within Canada and we could see that come over here.

@Deewani, had the Speech included the repeal of the Human Rights Act, all other business would have been dead as it would have taken up all the parliamentary time available (like sucking the Spam out of the room). But in any case, I have a feeling that the government has achieved its objective of planting fear in the minds of the ECHR judges to be more restrained in judgements affecting the UK and of planting disdain for the ECHR in the minds of the British electorate.

I don't agree the only people the tories planted disdain for is themselves.

ECHR has no care about the UK . The comservertavies could have proceeded and it would have only led to their downfall, just like Europe was conservatives downfall in John Major ' s days.

The reputational damage it would have done to the UK, would have been enormous. A national preaching about the need to uphold human rights and then seeking to repeal it.

It would have only shown the UK and the conservative for truly what they are.

The ECHR would have bid fairwell to the UK quite comfortably.

So the only winners and loses in the ECHR bill being postponed is the conservatives.
