family settlement or family visitor and 320 7b

Post by BYC » Thu May 28, 2015 12:03 pm

Hello great guys,
I need an advice on which application is best for my husband. He has been refused 5 years ago under para 320 7B from abroad, then I was under tier 1 general, we also lost the appeal.
Now i have ILR and our children have got British passport recently, I'm just wondering if we apply for him apply as a family visitor or settlement, at the moment I will have to work 8 to 12 months to meet the income threshold, I thought the visit visa is quicker in the meantime. Can someone advice which way for us to overcome the 320 7b. Thanks

320(7B) is no longer applicable for a spouse visa, but be careful of 320(11).

Many thanks Vinny, I have followed the links you sent, I found that 320 11 is a discretionary, do we stand a good chance if the eco considers the best interests of children?

Yes. Highlight the fact that you have children and they are missing their father very much.

Thank you, he scored 10 points for English language on Pbs calculator, that means he is OK.
