please help and advice for ILR

hi all,

i entered uk on 3sept 2004 on student visa until sept 2008 doing my diploma and degree

then sept 2008 to 2010 i was on PSW(post study work visa)

from sept 2010 to sept 2015 (currently i m on a tier 2 general visa)

i got married on 15th july 2012 in india

wife arrived in uk 3rd sept 2013 as a dependant - her visa expires with mine in sept 2015

what form should i use to apply for an ILR ?

does my wife apply at the same time? and is it the same form for her?

do i need to maintain any funds?

On what basis will you be applying for ILR as you qualify for 5 years residence and 10 years long residence? The answer to this will impact on what your spouse has to do but she cannot apply for ILR with you.

The form for you for ILR based on Tier 2 General & 5 years residence is Set(O).

Your wife does not qualify for ILR as she needs to spend 5 years as a PBS Dependent before being able to apply for ILR.

She can continue to extend her PBS on the PBS Dependent form visa until she reaches 5 years residence. She will also have to pay the NHS Surcharge of £200 per year, payable upfront at point of extension application. She should only need 1 more extension for 3 years to qualify.

Yes Sohail,

Government of the United Kingsom has introduced this new "fee" called NHS surcharge and it is applicable for all the applications on or after 6th of April 2015

There is no NHS surcharge for ILR applications but Sohail's question was about his wife's application and my response was for that.

Salary as per the soc code at that time in 2010

Or the latest soc code list from April 2015
