Tier 2 Dependent to Tier 2 General

I am currently in Tier 2 Dependent visa and have been offered a job by UK employer. To switch from Tier 2 general dependent to Tier 2 general,

1. Can i make in country application with restricted cos?
2. If out of country application, do i need to leave the job or continue working?

from home country with restricted cos.
you dont need to leave your job.

Thanks for the reply. Without leaving the job can go to home country , apply for the same job with restricted cos and continue working for the same employer. Is it? Since the job is not in shortage occupation, how can the employer do RLMT for the same job?. Thanks in advance.

Hi,

Iam currently in tier 2 general- dependent. I would like to change to tier 2 general. Iam currently working and the employer ready to sponsor the visa. How can they do RLMT and advertise for the post I work on? DO I need to leave the Job in order for them to do RLMT?

Is the employer on the approved sponsor list and do they have their license to sponsor?

Also, you need to apply from your home country, you cannot switch within the UK. Your clock for ILR will reset to zero and you will start a new 5 year qualifying period from scratch.

yes they are A rated licence sponsors and they can request for cos. But I would like to know how can they do RLMT for the post I am currently working on?

Also Is the time spent on tier 2 general dependent not counted towards ILR ?

On your RMLT question, perhaps user moonlight55 can answer.

No, the time spent on Tier 2G Dependent can not be added to the new 5 year requirement if you apply for Tier 2 G. The only time you can use a combination of different categories is for ILR based on 10 years long residence.

So once you apply and are granted Tier 2 G, you will start a new 5 year qualifying period for ILR.

How long have you been on Tier 2G Dep visa?

Also if my husband becomes eligible for ILR by the end of his 5 years? will I be automatically be given ILR?

They will have to advertise the job as per the RLMT guidance and prove that they could not find anyone from the local labour force. Only then they can apply for a RCOS for you.

No. Once you move to you own T2 General, you will have to spend 5 years on it to be eligible for ILR.

thanks all. So the employer can do RLMT still am in that position. If they cannot find a suitable candidate they can apply for cos still am working for them. Is that right?

My company is ready to sponsor through restricted cos as am working for them now. I would like to know does the employer need to do fresh RLMT or can the same documents ( Job vacancy posting in company website and other agencies ) be shown before they recruited me for the job which is less than 6 months?

Also for the salary requirements do I qualify for new entrant or experienced?

Does the code 2136 comes under shortage occupation?

Please read full RLMT instructions.

Also for the salary requirements do I qualify for new entrant or experienced? - This depends on the length of the visa. For 5 years, you would need an experienced worker salary.

Why do you wish to change to Tier 2 (General)?

Is your spouse not able to apply for ILR under Tier 2 (General)?

Why don't you want to remain as a PBS dependant and apply for ILR when eligible?
