Overstayer - pending criminal case!

Hi all

I have someone who has been served with an IS96 but he has a pending crown court trial. He has to sign on at Eaton House.

Is there a chance he will be removed without having a chance to stand trial?

I would say it depends on the nature of the offence. But I would imagine that the relevant authorities would not allow the Home Office to remove someone if there is a possibility of them being charged/sentenced etc.
