Maternity Gap, Minimum working Hours & Pay for (EEA)PR

Post by dhrupadidhamaka » Thu Jun 04, 2015 5:39 am

My wife is EEA national. In her current employment she is working for three years. In between last three years she was in maternity leave for 39 weeks and got statuary maternity pay as income was low. After her maternity leave she again join in the same job and continuing till now. In her job she works 12-15 hours/week and earns £70 to £80 per week.

My Query is:

1) How Maternity gap will affect on her continuous treaty rights ?
2) Do you think 12-15 hours work per week and earning £70 to £80 per week will effect in her treaty rights.

What is the exact law for above mentioned issue.

I will be really grateful if I get some kind advice for above mentioned issue.

Thanks in Advance...

As far as I am aware, SMP is not a gap, it counts like worker status.
All information given is just my opinion as a member of this forum and does not constitute immigration advice.

Hi
She's absolutely in order. There's no earnings limit but the recommended average is 663 per month.

buktais, omonile, LilyLalilu thanks for all of your kind reply.

Actually still now I am not sure about weekly minimum works or income. As far I know minimum 10 hours/week should be fine. If I get refused for low income, do you think it will be against the EU law and I can appeal. I am really stressed regarding that..please help me with your advice....Thanks

My (wife) is EEA national. She worked from 02/06/20009 to 07/05/2010. There's two big maternity gap and family commitment towards bringing up the child, from 08/05/2010-15/07/2010- Pregnant, 16/07/2010 to 02/02/2012 - family commitment towards child, 03/02/2012 to 03/11/2012 - pregnant, 04/11/2012 to 24/09/2014 family commitment towards child, from 25/09/2014 she was looking for work but never claim any jobseeker. from 22/03/2015 she is employed as a care-worker working weekends 4 hrs.

My query is

Will she be considered qualified person as a EEA National and can she apply for PR.

Thank You
