Student Loan Support for an ILR-LR's dependant on FLR(M)

Post by msunmy » Mon Jun 01, 2015 8:37 pm

Hi All,

Does anyone knows if the type of the dependant refers above could obtain such support.

I know that dependants on FLR(M) do not have access to public fund but i am confused about this '' Right of Permanent Resident'' http://www.ukcisa.org.uk/International- ... ment/#ropr saying such can have access to the support. Is this a new rule though as it says somewhere ''these provisions from EU law, extended the right to all qualifying non-EU EEA and Swiss nationals, and their family members....''

Many Thanks

That appears to apply to people subject to the EEA Regulations only.

2 Questions to give advice:

1. Do you intend to naturalise as British?

2. How long has the said FLR(M) applicant been resident in the UK?

Once you've answered them, I can say whether support can be granted.

When was the FLR(M) initially applied for?

its abut a month now and we are from the commonwealth area.

I am on ILR/LR and I know my dependants with the FLR(M) can not rely on my visa, as they'll be able to apply on their own after 5yrs

One of them would need to go to Uni before the 5yrs lapses and would also be over 18 by then.

I am concerned about how I'll be able to fund her Uni with the huge visas fees /charges (without a penny benefit been collected over a decade) which has turned me completely POOR with no means left to assist/support people needing help back-home.

I am not keen naturalising (as I'll like to leave their kontiri asap) but I am hoping doing so 'might' help the kids schooling at least.

Thanks

Once you are British, your wife/children should be entitled to student finance and be classed as a home student for fee purpose as they have been here 3 years+.

Thanks Amber,

If I become 'naturalised' after a year on ILR/LR, could that accelerate my dependants' ILR or they have to complete 5yrs on FLR(M) apart from that My spouse came in 05/10 and would be clocking 10yrs around same time the 5yrs would complete. ?

For example, a spouse/partner of a British citizen that comes in today would stay far-lesser period to get ILR. 'Equal treatment' they always say.

You are incorrect. It is 5 years route to ILR for all now.
