Immigration for my 83yo mum

Immigration for my 83yo mum

Hello there...

I have just been naturalised myself and hoping I can take my elderly mum living with me as I am increasingly worried about her living on her own... Is there a way I can bring her? Which route to use, what are the requirements to satisfy and whether there is any experience the fellow members can share?.,,

Details; she lives on her own, 83 yo, has a son (my brother), pensioner 60yo living in a different city, married.

I really appreciate your help, guys

How it can be impossible?..... She is on life long medication for her heart condition, just been taken to hospital with pre-heart attack condition, every time I leave her after a visit I am scared I see her the last time... I do call her from here every day to check on her, but this is not enough... She is weak and finds it difficult to cook, go out the flat on her own, etc.... She is widowed and has no family in the place she lives. My brother lives in the same country by 150 miles away and does not visit her often, neither calls her often: he has a heart condition himself.... There must be a way................

She also has a dimentia, not very severe yet, as she still remembers me, but she forgets simple things, where she is and confuses things as well...

The hard facts are that under the updated Regulations for settlement of elderly dependent relatives, unless your mother requires daily care for washing, dressing and everyday tasks and the care is either not available or unaffordable in her home country (for you to pay) the visa will be denied. There have been only a handful of successful applications since these tougher rules were introduced and one of these was after a very lengthy court appeal. It would also go against you that she has family in her home country who choose to live in a another city and could contribute to her care.

Thanks Casa.... Is there a way of bringing her on s temporary visitor visa and extending this visa for as long as needed? I don't need free nhs, own a 4 bedroom house, can accommodate her without any problem, etc.... And will repatriate her remains to her home country as this is her wish anyway. So I don't need any state support....

In order for a visitor visa application to succeed, you'll have to show that there are very strong reasons for her to return to her home country without overstaying. Due to her age and the fact that she lives on her own, this may be difficult to prove.She would be unable to switch to an elderly dependent visa from within the UK. Read through the information in the link regarding extending a visitor visa which requires exceptional circumstances and can't be extended indefinitely. The authorities are wise to the fact that families are attempting to use this route in order to bypass the rules.

Do bear in mind that if you apply for an elderly dependent visa and this is refused, any applications for a visitor visa in the future will almost certainly be refused due to the previous intention to settle.

I'm sorry I couldn't be more optimistic. The Home Office have virtually closed the door for the settlement of elderly dependants.

For all it is worth, given the situation you have described, you may also want to look at going down the Surinder Singh route.

The Joint Council for the Welfare of Immigrants is looking for a test case to argue against the Adult Dependant Relative route restrictions in court. They also run a consultation surgery to advise further on it. Given the care your mother appears to need, you may wish to take the matter up with them.
