Child born in UK to ILR father and Spouse Visa Mother

Post by huqqapani » Tue May 12, 2015 10:29 am

Hi, we are expecting our first child to be born this June (iA). I have been granted citizenship (ceremony 2nd June 2015). My wife is on Spouse visa. What is the process of registering the child etc. Am I right to assume that the child will automatically be considered British ?

If the child is born AFTER you attend your citizenship ceremony, the child will automatically be British and there is no need to register the child as British on form MN1.

If the child is BORN before you attend your ceremony, citizenship will depend on where the child is born (in the UK or abroad).

Thanks CR001

Child will be born in UK. So if born before naturalisation, what would be the procedure?

As born in the UK and you have valid ILR, the child will be British automatically (this is not the case if born abroad to parent with ILR, hence my question of where birth will be).

So for clarity, if born in the UK either with you on ILR or after your ceremony, child will be British and you can apply for a passport directly.

Hi. My son was born on 29th May, 3 days before my citizenship ceremony on 2nd June. So how do i go about applying for his passport. I have registered his birth and have received the birth certificate. I am about to apply for my passport, can i apply at the same time for his passport or do i wait until i get my passport?

Please advise.

You can apply for his passport but you need to send proof of your ILR and foreign passport.

Is this if I am applying for his passport at the same time as mine.

If I apply for mine first, then what do I need to send with his passport application?

You can send photocopies of your foreign passport and ILR BRP with the child passport application.
