Guys I have been reading a lot regarding appeal changes so thought I share my experience. Changes in appeal process is for tier 1 to tier 4 settlement visa I.e none British nationals settled in UK. There is no changes is appeal process for British nationals as its technically human rights as this is ur right to live with your spouse and it has impact in your life. Please check with proper immigration lawyers not some one sitting in corner shop claiming to be one.

Recently 2 people have imprisonment sentences given for providing wrong advice. Please check or scroll hundreds of pages and you will find it that there is no such change for spouse visa for British citizens. Also I am yet to see but the 30 day visa thing is a myth as yet, because I also been
told that visa is exactly the same I.e 33 months.

I applied in March refused in April seek proper advise and decide to apply again in April. Refusal was only that we did not attach proof of contact. Include marriage cert, pics etc but not enough obviously couldn't be bother to wait so decide to reaaply although solicitor said there is strong possibility for it to be overturned.

I pray for SajjadUk and others, we have same name al ham du lillah Bruv. If u do or even have good intentions for other angels help you. May Allah grant every one visas soon Ameen

Everything is so complicated..

Hello All,

Please I'd like to clarify something.

My husband is British Nigerian
Our baby is British Nigerian
I'm Nigerian and I only just got my spousa visa yesterday.
Looking to move to the UK ending of July. Please I'd like to confirm something.

Can I husband claim child benefits for our baby?
How will this impact on my application fro FLR(M) in 2018?

Thanks

I have been reading this thread for many months and I have been keeping up with people’s timelines even though I did not apply from Pakistan. I applied for my husband’s visa in a European country at the beginning of January (thinking it would be quicker(!)) and so far I have had no update. It has been very difficult at times and patience does pay off. I have entered my 23rd week and I have escalated a few times during the last few months but all I get back in “visa under consideration” – which is a very frustrating answer. I am requesting duas from you guys, I really don’t know if I will hear back within the 24 weeks which is supposed to be the maximum timeframe? I have rang the embassy number a few times, get put on hold and a standard “still being processed” answer follows. For those of you waiting, it is hard but patience is a virtue and something I am constantly reminding myself whilst going through this test.

Do they have to respond within 24 weeks? I can wait another week but I am concerned if I do not chase, I will get nothing.
Some cases are abit complexed or there are certain checks that take longer which causes delays. Yes 24 weeks is the maximum in Shaa Allah you should hopefully hear back very soon
It's not always the case where the keep sending response of the standard set email saying still under cconsideration it's possible that they may be in touch anytime.

Will be remembering you in duas

Did you include a covering letter ??
P60 ?? Was you with current employer less than a year ?? Just confirming though that wouldn't matter as they check with hmrc that the wage slips are genuine and that you are in employment so Aslong as it's 6 months it's fine as far as the rules go

Your husband can't claim child benefit but you as a British citizen can apply in your own right and that shouldn't have any implications for FLR. As you are not claiming additional funds to support husband.

That can't be correct as looking at your post you applied 9 weeks ago.

I would suggest email them again and specifically ask why there is no record or update and state when and where you applied.

Sometimes they don't log updates onto system and yet people still get an email once everything is processed but that's chance which I wouldn't expect you to take just incase there is an issue.

You shouldn't have any issues in Shaa Allah just the p60 would have been highly recommended since you have been with your employer for so many years.

But in Shaa Allah hopefully that shouldn't cause an issue as they check with HMRC anyway

Did you send a translated marriage certificate. .. just confirming though I'm guessing you would have

Personally I don't think it is good idea to go over the top with paperwork when making an application. You just need to provide enough proof and not every single proof. You should cover most points in your covering or sponsorship letter.

Aslong as suffice evidence is provided for each section then it should be enough and everything varies from case to case

Sorry misread and nope Aslong as he claims the benefit in his own right there wouldn't be any issues
When he does become eligible to claim hosuing benefit he must inform the council that you will be living with him and that you have no recourse to public funds. What they may do then is deduct a small percentage but this is under the discretion of the council and they don't always choose to do that.

Keep all correspondence to and from and of the agencies in a file including dates of any calls made and names of who you spoke to. This is just to cover your back that your husband did everything within law and informed each agency that his wife has no recourse to public funds.

It's all down to the discretion of the ECO
I wouldn't be able to say alot more myself as there have been cases where the visa has been granted and some not
Don't be disheartened as you have covered most so it's just how the eco interprets everything as sometimes people provide so much and still are refused.

I wouldn't say they are major mistakes no

@lush

Just went through the guidelines to double check
Quote:
A person subject to immigration control is not considered as accessing public funds if it is their partner who is receiving the funds they are entitled to.
Child and working tax credits are claimed jointly by couples. If only one member of a couple is subject to immigration control, then for tax credits purposes, neither are treated as being subject to immigration control.
A person subject to immigration control can claim certain public funds when they have a right to reside in the UK if they live with a family member who is:
 a British citizen, or
 a national of a country in the European Economic Area (EEA).

Source: http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

Plus went through my council website and housing benefit can then be claimed in the british citizen own right but they still need to be told about partner no recourse to public funds which they will note but will be disregarded

Salam brother sajjad,

Hope you can advise me, I recently applied for my husbands visa application but when he handed the file in at Mirpur he has not submitted one part of his English test certificate, he had taken the CIty and GUilds and you receive two certificate's one for spoken and one for listening, he assumed both certificate where the same, but one was for each part. Is there anyway you can submit a missing document once the paper work has been handed in?

Many thanks

I have been a silent reader on this forum for few months now and i would like to thanks all ur help and support here.
My wife submit the appilcation on 27th april 2015.
we ask for update on 13 may 2015and got a reply "your application has not yet been assessed by an Entry Clearance Officer (ECO)"
Ask for update again on 10 june 2015 and a reply "there are no current updates. This could be because your application was submitted recently or the details that you

They state that it is not possible to send further documents later and decision will be based on the information provided.

However you should have given the details of the certificate on your online application and they would hopefully be able to confirm without sight of the actual certificate, so you are not actually providing them with new information.
