Does Naturalization refusal also ceases existing ILR

hello members,
If a naturalization application refuses due to having some problems in immigration history like breach of visa condition for example a student work full time during some period then whether the refusal also cancels existing ILR or ILR continue to exist?????

Unless they believe that your ILR was obtained by employing some kind of deception, this should have no impact.

The rejection of a naturalisation application by itself does not lead to the ILR cancelling, but it may bring the case to attention of the Home Office.

If the Home Office were to cancel your ILR, it would notify you in writing. So, read your letters and documentation carefully.

I do not think that there is much difference between the checks they make during granting ILR and naturalization. Because they invented the term "Good Character" but already its all ingredients they check before granting ILR then isn't that stupidity to re-check again :x :roll: ??

A lot of things can change between the time an individual attains ILR and the time that individual decides to apply for citizenship. Some of those things might have nothing to do with new interpretations of good character.

See also can ILR be cancellable. However, if you are granted British citizenship, then ILR ceases to exist.

Whether the first post involve deception? Based on common sense no because working/earning wasn't/isn't necessary to get ILR on 10 years basis in contrary to tier 1 extensions where earnings are necessary?? Isn't it??

Just a curosity that if a naturalisation application gets refused due to working when not authorised like working for 2 companies on a student visa.

1. Will ILR gets effected of the applicant.
2. If yes then what will happen to spouse's ILR also in process of naturalisaton?
3. What are the implications on children who are already british?

1. As said above it can be affected if the caseworker sees this as deception so basically depends on the case worker. But realistically I think it would be very hard to substantiate that you were working more hours than allowed. There is nothing that says you cannot work for more than one employer so that should be fine.
2. Chances are it will have no affect on spouse ILR because this could lead to a long long court case with so many arguments - so probably no effect.
3. Again chances are that nothing will happen.
