When can I apply for ILR

When can I apply for ILR

Hi All,

I have a few queries regarding my ILR application. Here are my details

Came to UK on tier 1 General
First entry clearance stamp : 14 Jan 2011
First UK Entry : 01 Apr 2011 ( within 90 days from the first visa stamp as mentioned above )
Switched to tier 2 General within UK ( company sponsored ) : 10 Oct 2012
Changed employment ( Tier 2 General ) : 06 Jan 2014
Current visa & validity : Tier 2 General valid untill 06 Jan 2017
Not stayed more than 180 day outside UK any time during the 5 years

- Could some please let me know when can I apply for ILR ?
As per my calculation & the information I gather from this form, 14 Jan 2016 I will complete 5 years & should be able to apply 28 day before this day, that is around the 17 Dec 2015. Could someone please confirm if I am missing something.

- My Daughter is born in UK & she has a dependent visa until 2017 like mine. does she has to apply for ILR ??

Any suggestions/reply would be of great help

It's 5 years (minus 28 days) from when you entered. The grace period back to entry clearance is for people whose visas will expire before the 5 years from actual entry.
As to your daughter, as she was born in the UK, you can register her as a citizen after you successfully receive ILR.

Please don't give incorrect advice.

OP, the 90 day concession is available to you and provided you meet all the standard requirements, you can apply no sooner than 28 days prior to your visa stamp date as you entered within the 90 day period.

Can someone please clarify the above ?? My solicitor mentioned since I am applying for ILR from tier 2 general, I can only apply 28 days prior to my first entry ( i.e 28 days prior to 1 April 2016 ) & not now. The 90 days concession for tier 1 will not be valid.That is only valid if I was applying for ILR with tier 1 general. Experts please clarify when can apply for ILR given my situation. Many thanks.

Did your solicitor have a similar case refused on this basis?

No Vinny. He has not mentioned about any prev rejections.

Just to add to the above, I entered on 1st Apr searched jus bs for 3 weeks and eventually found an offer. After 3 weeks I went back to India and came back on 29th May 2011 & joined. ( ard 35 days )
Does this matter at all ??
