Bad new guys they refused my visa guide me what should i do now ? Oral hearing or paper provided?

A week after we received determination letter saying the appeal is allowed, I've just called the Tribunal to ask about time frame for visa being stamped... they told me the home office have applied to appeal the Judge's decision :(

Anyone with any experience in this? How long does the Judge take to decide if there is grounds for an appeal?

Surely there is a chance the Judge will deny the Home Office's application for an appeal to upper tribunal?

Home Office would only take it to an Upper Tribunal if it thought it had a reasonable chance of success. If the Judge agrees that there is some merit in their argument then he will not refuse their appeal unless it is a clear black and white case.

You need to get legal advice from a different solicitor and if you have good chance then go with appeal otherwise it is much quicker and cheaper to make a fresh application. It could be several months before their appeal is heard.

It is best to take your time and do it right the first time rather than rush and face problems and heartache later.

That's a quick turnaround as in most cases they are still on end of March and Start of April.

We applied on 19th May and its been 4 weeks this week, i was hesitating to request a update because i thought it may be too soon, but if ^as above, 18th May applications are being assessed i think i should request a update.

Does anyone know how this can be done?

the net pay shown on one of the wage slip did not reflect the cheque that was deposited into my wifes account. the reasoning is because my wife was paying too much tax on her second job (part time) so hmrevenue told her employer to return it and not charge her tax from her part time job because she is paying all the tax required from her full time job (first job). second employer then gave 2 cheques for the month one giving the tax back and second cheque her monthly income from the job. however the accountant made a slight error on the wage slip the tax refunded is less then what was deposited into the account by cheque. its just an error that was made by the accountant. so eco has refused it on basis of income threshold for that ONE MONTH. tax everything else all papers everything fine. just that one month the cheque given was incorrect to whats stated on her wage slip. now I don't understand what we should do? do I have the option of having the decision overturned with evidence provided from the accountant and hm revenue? or do I appeal and if I appeal how long is that process? or submit a fresh application?

If you read the last few pages there will be a link there or alternatively there will be a link in the email you received when you submitted the application.

An application being assessed in 4 weeks is very rare, 8-12 weeks is the norm.

If you submit new evidence they may change their mind. Otherwise it could take several months for it to go to an appeal, so it could be better to make a new application.

Prior to this when I asked for an update it was some thing along the lines of "being processed"

Achaa that's the same reponse that I get ...
Now what will happen is the file will be looked at by an Entry Clearance officer when all prior applications have been dealt with so in this case all of April applications
