DOJ allows only weak/dodgy cases like KUMAR to be heard in court where they are fairly confident the judgement would be in favour of the DOJ. they apply the judgement as a validation of their E.U spouse policy even if they are in no way similar to Kumar. It's difficult to believe a so-called 'European' country can act in such a sneaky manner.
