Citizenship and expiring current passport delima

Post by s0787671 » Fri Jun 19, 2015 8:09 pm

Dear members,

I have serious issue.

My PR visa was issued on 15 sep 2014. So I am assuming entitled to apply for Citizenship on or after 20 Aug 2015. But my Indian passport is expiring on 20 sep 2015. Do I ignore and and apply straight for Citizenship in August or renew my current Indian passport and then apply for British citizenship.

You can apply with your current passport, it will not affect your application if it expires while application is being processed.

You have to have had your PR for at least 12 months which means you can only apply on or after 15 September and my understanding is that you can't apply with an expired passport (I might be wrong on this one).
Naturalisation timeline: EEU PR
Application date: 17-03-2015
Fee deducted : 24-03-2015

OP, you can apply with your passport, it will not affect your application. As badratio has said already, you can only apply once you have held PR/ILR for exactly 12 months. There is no '28 day grace' period for citizenship applications.

My passport is expiring on 21 sep 2015. So even if I send the application on 15 sep for Citizenship, it is a risk isn't it?
Just need need a honest reply.

Thank you

I am sorry, but I couldn't find the links. Could you please point to them.

I am assuming if I send my AN application on 15 sep 2015( PR given from 15 step 2014). Even if my passport expires, once UK I migrations receive my application, it wouldn't affect my application for naturalisation?

If that's the case, then it will fine to do that as it would save me having to pay a new Indian passport now and then surrendering it for a British passport, also I believe since I have PR , Indian embassy would require a letter UK agency confirming I haven't obtained citizenship, before issuing a Indian passport, I wanted to save my self all this hassle.

Please correct me if I am wrong. My concern being that if by chance they state you can't apple for citizenship with my passport expiring in a few days, i don't want to be get my PR getting nullified as the passport has expired. It's pretty confusing, as my understanding being that , PR biometric card only valid with a valid passport, so not valid if passport expires, which in turn means my permanent residence status abs stay in UK, in danger.

Thank you
Bharat

Links are the underlined items.

From the first link:
Ubwa wrote:I applied with my passport having expired in 2005. You will just have to ensure you have some proof you where in the country to cover the expired period. Was no issue at all.
From the second link, Annex B: residence requirements, confirms that it shouldn't be a problem.

Moreover, ILR doesn't expire.
