Applying ILR / Tier 2

Post by surya123 » Mon Jun 15, 2015 10:37 pm

Dear Sirs / Madams,

I am applying my ILR in July (2nd week), I have some doubts about application, Can some one help me,

1) I am applying with my wife (she is dependent visa from 2010), can we use 1 application for both (SET (O) form) ?

ANS:

2) My wife taught degree in English, India. which one can I tick it (Page no. 16) we didn't do UK NARIC but she got University certificate.

ANS:

3) In Section 6 - Immigration History - 6.1) when did you first enter the UK

I came to UK in 2005 but my Tier 2 approved date was 16.07.2010. So, which date can I write it ?

ANS:

Could you please give me answers for the above questions.

Thank you very much.

1) I am applying with my wife (she is dependent visa from 2010), can we use 1 application for both (SET (O) form) ?

ANS: You and your dependant can apply on the same form provided she meets all the requirements .

2) My wife taught degree in English, India. which one can I tick it (Page no. 16) we didn't do UK NARIC but she got University certificate.

ANS: You will have to check that your wife's Degree , qualification is mentioned in the UK NARIC and keep a print out , If not she will have to take the English Language Test as per the new requirements .

3) In Section 6 - Immigration History - 6.1) when did you first enter the UK

I came to UK in 2005 but my Tier 2 approved date was 16.07.2010. So, which date can I write it ?

ANS: The first date you entered the UK i.e. 2005

If I am wrong , Dear Moderators please correct me .

Zum, the last answer is wrong. rest all seem perfect.

The full question 6.1 is

"6.1 When did you (the main applicant) first enter the UK? This refers to the date of your first entry into the UK at the beginning of the period of stay on which this application is based."

The application is based on Tier 2, so the first entry should be the date on which you entered UK after getting your Tier 2 visa in 2010.

Dear Gurus,

I am living in the UK more than 9 years but my Tier 2 visa approved in 2010. Should I write 4 years and 11 months or 9 years 4 months ?

In the section 7.11 question: How long have you lived in the UK ?

Also, my wife got IELTS certificate in 2007 but she never used for home office visa purpose. Is it ok for use SET (O) application form (Dependent visa) ?

Could you please answer my questions.

Kind Regards,
SS

SS,

Are you applying on the basis of Long Residence or Tier 2 ?

If Long Residence then write 9 years 4 months and if Tier 2 then please write 4 years 11 months.

Has she used this IELTS certificate in any of her prior application ? If yes then she can again use it without any problem.

If not, then if this IELTS certificate is still valid (not expired) and is in the list of Home Office's English Qualifications, then she can use it.

Good luck

Post by rkbadineni » Sun Jun 21, 2015 6:57 pm

HI,

I am planning to apply ILR in next month , could you please read my case and let me know am i eligible for ILR.

I am currently holding the TIER2 ICT LONG TERM (LEAVE TO REMAIN) VSIA which is valid till 22-DEC-2017

I first came to UK in SEP 2009 on TIER2 ICT MIGRANT VISA and i am still renewing the same VISA till date

My question is i was away for a period of 574 days(APR 2013-NOV2014 suring this time my visa is valid ) back to my base location in India due to medical reasons ( my wife miscarrigae the baby and not get proper medication in UK , so we went back to india )

during this time i have not been paid any UK salary only i have been paid indian salary.

Again i was deputed back to UK in NOV 2014

Please find the my UK Start\end dates and entry exit dates (My VISA never Expired in India , i was renewal every time before it get expired in UK)

VISA Category - TIER2 ICT LONG TERM (LEAVE TO REMAIN)

My first entry date to UK - 27-SEP-2009 Exit Date 26-JUN-2010 - Reason-Vacation
Re entry date - 11-JUL-2010 Exit Date 30-APR-2011 - Reason-deputation back to base location (INDIA)
Re entry date - 10-SEP-2011 Exit Date 21-JAN-2012 - Reason-Visited base location on Business trip (INDIA)
Re entry date - 02-FEB-2012 Exit Date 09-AUG-2012 - Reason-Visited base location on Business trip (INDIA)
Re entry date - 31-AUG-2012 Exit Date 06-DEC-2-12 - Reason-Visited base location on Business trip (INDIA)
Re entry date - 18-DEC-2012 Exit Date 13-APR-2013 - Reason-deputation back to base location (INDIA)
Re entry Date - 08-N0V-2014 Presently in UK, Visa valid till 22-DEC-2017

So is my case strong enough to apply for ILR ?

DO i need request my company to provide any letter ?

DO i need to submit any medical records while applying for ILR?

Please elt me know your suggestions ?

Cheers
Krishna

I wanted to apply naturalisation for them when I get my ILR (they born in UK).

I am not absolutely certain, but the registration process for your children (children get registered, adults get naturalised) will be separate to your ILR. I'm not even sure that registration for children can be done at a PEO/PSC. I think it must be by post.

On the positive side, children born in the UK are entitled to be registered under Section 1(3) on Form MN1 when their parents get ILR. That means that they can not be refused British citizenship.
