Tier 2 change of SOC code

HI
my tier 2 visa expires in Oct. However i want now to change my SOC code with my current employer.
1- can i get my new visa for 3 years and 4 months sothat in total i will be 6 years on tier 2
2- if so should i pay the fee thats paid for 5 years applications just for the extra 4 months
3-if i just apply for 3 years is there any consequence on ILR
