Tier 1 General Dependent Maintenance Funds - April 2015/16

Post by mrvaibhavpanchal » Sun Jun 21, 2015 3:43 pm

Hi,

Under the new published guidelines for Tier 1 Dependent, I am a bit confused how much exactly I would need to show as part of the maintenance funds for Tier 1 Dependent.

My situation

Living in the UK since Feb 2012 under Tier 1 General visa due to expire in August 2017 (after multiple extension).
My wife, who has never been to the UK, is planning to apply from India in July 2015.

The document recently updated on 06th April 2016 https://www.gov.uk/government/uploads/s ... e_0415.pdf) says

MAINTENANCE REQUIREMENT

Family members of Tier 1 (General), Tier 1 (Entrepreneur) and Tier 1 (Post Study Work) migrants

48. If the Tier 1 Migrant is outside the United Kingdom or has been present in the United Kingdom for less than 12 months, you must show that you, the Tier 1 Migrant, or (for children) your other parent who is also legally present in the United Kingdom have at least £1890 to support you; this is in addition to any funds the Tier 1 Migrant needs to prove they have enough money to support themselves.

49. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, you must have £630 to support yourself.

50. For example, the Tier 1 Migrant has been in the UK for 6 months and is making an application at the same time as their spouse and two children. They must show that they have £1890 for their spouse and a further £1890 for each child, in addition to £945 required for their own support. In total the family will require evidence that they hold £6615 in available funds (£1890 x 3 = £5670+£945).

51. If the same Tier 1 Migrant and their family had been present in the UK for two years, they would require evidence that they held £2835 (£630 x 3 = £1890 + £945) in available funds.
As per my understanding, I should show £1890 for a continuous period of three months. Is that correct? If not, what is the right figure here?

No its not £1890.

This is applies to your case - 49. If the Tier 1 Migrant has been in the United Kingdom for 12 months or more, you must have £630 to support yourself.
And Each dependant must have a certain amount of money available to them - this is in addition to the £945 you must have to support yourself.

So you must show £945 + £630 = £1575

It is 630 (for you, since you have been in UK for more than 12 months) + 1890 (for your wife planning to apply for the first time) = £2,520. For each additional dependent, keep adding another £1,890

That is incorrect. Its £1890 for each dependent if they are coming along with OP for the first time (i.e OP is less than 12 months in UK)

As the OP has already been in UK for more than 12 months, his dependent is travelling for the first time, he needs £945 for himself + additional £630 for each dependent.
