Tier 2 General in-company role change

Post by helpMeOut » Tue Jun 23, 2015 1:25 pm

I am currently on my first Tier-2 general leave (total of 3 years). I still have 1.5 years left on my visa and I am 26 years old.
My company has a new opening for a job falling under a different code compared to my current leave.

I do not have the formal qualification for this other job, but I have been doing bits and pieces for it as I have basic knowledge for this job role and my company is willing to put me in that role and provide further training to take over this new role as they are not successful in hiring anyone for this role.

1) Do we need a new CoS for this job change (as it is a different job code)? If so will I have to make a new Tier 2 General application with the home office with a new CoS?

2) Can we make this new application before my current leave expires? My employer can provide CoS with job duration for a maximum of 3 years. If we make this new application, will I get a new three year visa or will it be within the current leave remaining (1.5 years remaining)?

3) If we wait for another 5 months, I would have completed 2 years on my current leave and then apply for this job switch which provides 3 more years, can I use this 5 year period for ILR later?

4) Also because I would undergo some kind of formal training for this new role, would the salary requirement for cos be new entrant or experienced?

Thanks,
- Sam

Hi I am not an expert but replying as you have posted this couple of days ago and no replies found yet -

1) Do we need a new CoS for this job change (as it is a different job code)? If so will I have to make a new Tier 2 General application with the home office with a new CoS?
Yes this will be new application as your employer is trying to fullfill a job out side EU and this needs to be justified and considered as a Tier2 extension - salary criteria and occupation code will be considered

2) Can we make this new application before my current leave expires? My employer can provide CoS with job duration for a maximum of 3 years. If we make this new application, will I get a new three year visa or will it be within the current leave remaining (1.5 years remaining)?
if you make a new application it will be considered as extension of leave - u can apply up to 6 years as this is the max time u could stay in this country in this form of visa - so there are 2 option either 3 years or apply for remaining (6-1.5 = 4.5years) obviously u will have to pay £200 per year additional for health surcharge recently introdcued for the total year of stay in advance .

3) If we wait for another 5 months, I would have completed 2 years on my current leave and then apply for this job switch which provides 3 more years, can I use this 5 year period for ILR later?
I dint realy get your question - however if u stay for 2 years you can apply for 3 years or upto 4.5 years ( see answer 2)

4) Also because I would undergo some kind of formal training for this new role, would the salary requirement for cos be new entrant or experienced?
As long as you are above 25yrs and applying for tier 2 visa you are considered as experienced proffesional - you are not a new entrant as per UKVI - this is a bit grey area but unless u r recruited as a graduate trainee or milkround scheme most likely u r experienced proffesional -

hope this helps
