Refusal please help

Post by soma7474 » Wed Jun 24, 2015 9:30 pm

I applied for Tier 2 visa, and my application was refused on the grounds that

we are not satisfied that on the balance of probabilities your sponsor requires a business Development manager for their organisation. The reason for this is due to the size of your sponsors business being relatively small....

This is the only point on which my application is refused however the position is quite clear in the hierarchy of the firm. Neither it is a very small firm.

Can you please suggest any paperwork to defend my case.

Gurus please help...!!

The title of Job is business development manager.

Proposed sponsor is LAW FIRM Not small size, medium size deals in convincing, immigration, injury claim etc

This genuine vacancy exist in in their hierarchy chart. Home office didn't used their discretion to request further information and home office presumed that our organisation is small without any information and their decision is totally biased.

Why isn't your law firm's immigration specialists helping with your/their problem?

The reason for your refusal MIGHT be related to this. The BDM position was abused before.

I am not saying your company is bogus. The home office is may be becoming jittery because this role has been abused before.
BTW how many Tier 2 sponsors has this law firm done before?
If so what is the % of tier 2 employees to UK/UE employees.?

Since Nov 2014 home office has the power to use discretion and can reject applications if they feel are doubtful.
