I have the same situation and my breakup is as below

14-Jan-2010 to 14-Jan-2011 (20 days annual leave)--->Year 1 (year first arrived will not be using this)

14-Jan-2011 to 14-Jan-2012 (20 days annual leave)---------------------------------------->Year 1
14-Jan-2012 to 14-Jan-2013 (20 days annual leave+60 day unpaid paternity leave)---->Year 2
14-Jan-2013 to 14-Jan-2014 (30 days unpaid leave for my 1yr old son's treatment)---->Year 3
14-Jan-2014 to 14-Jan-2015 (150+ days unpaid leave for my son's treatment)---------->Year 4
14-Jan-2015 to 14-Jan-2016 (20 days annual leave)---------------------------------------->Year 5

note that my visa is valid till DEC-2016 but I am eligible by this July2015 for ILR as already I have done 2 extensions in order to avoid 180 days rule per eligible year I am breaking my unpaid 6 months (exactly 180 days) leave within Year 4 and Year 3 from the date of planned application date. I am still with the same employer and can provide letters and communication which I had with my employer for my unpaid leave for my 2yr old son.

So would highly appreciate if my above planning is correct to go for ILR in Jan16 or can still wait till Dec16 as I have visa till DEC16 but I am worried some new Fee increases and rule changes to ILR rule may come into rule by april16. CR001 and other senior members pls guide me appropriately and I think this will help the above person who posted this request also.

hello all now i am eligible for ILR but due to 180 days absence i am waiting to split the absence in 2 calendar period. I am bit concerned if there will be any changes in the ILR rule so bit nervous to wait if members here can visit my posting and suggest if it is wise to wait or ok to go for ILR now. I think i exactly have 180 days absence and i have listed the way i am planning. Pls forum members guide me....

Hi

I Think I am feeling that you are not given the full info ...it is easy to calculate your ILR eligible date. Below is the example..use it and try to calculate yourself.

From the below example 11 November is the ILR date....from there count backwards and list your absences...make sure that your absences should not be more than 180 days in any 12 month period. If still queries on ILR eligible date will try to help you out with the help of other Gurus and seniors....

Year 1 : 11 November 2015 to 12 November 2014
Year 2 : 11 November 2014 to 12 November 2013
Year 3 : 11 November 2013 to 12 November 2012
Year 4 : 11 November 2012 to 12 November 2011
Year 5 : 11 November 2011 to 12 November 2010

stanza thanks for your response. I understand now it's the backward order but still My query here is not about ILR eligible date it's about waiting till 2016 in order to split the 180 days absence into 2 calendar yrs. Technically I am eligible to apply this month but I am waiting for safer side to try to split the 180 days absence into 2 eligible calendar yrs. If you read my post you can clearly understand my difficulty as exactly i have been out of the country for 180 days. If any one can advise if it is worth to wait or to go ahead now.
