I am an Indian citizen. My spouse is Slovakian citizen. I have Temporary residential Card. We want to move to UK. I applied for EEA family permit. I want to know that:
1. After having EEA family permit, if I always need my EU spouse to enter in UK in EEA family permit validity?
2. As I read EEA family permit include work permit, If my spouse come to visit to Slovakia for 2 months then is it illegal to work for me that time though I have 6 months family permit?
3. For EEA resident card, is it mandatory for my wife to get a job?
4. If I arrange a job but my wife cannot arrange a job then can we apply for EEA resident permit?
5. If I arrange a job before my wife, can I apply for work permit visa?
6. How long we need to stay in UK to get EEA resident permit?
Please assist me if you can.
Mayakanon, lots of questions, let me try to help a bit from my experience, and maybe someone else can complement.
1. WITH the family permit it is not necessary for you to enter the UK with your wife, although it may make things a bit easier.
2. Family permits may or may not include work permit. Once you arrive with your family permit, you apply for your residence card, which again, may or may not have a right to work, The residence card application needs to be done while you are here in the UK.
3. For you to get a residence card, it is necessary for your wife to exercise treaty rights, and for you to be able to prove it. She needs to be working, studying, be self-sufficient or looking for work. You will need to get private medical insurance for at least a year when you send in your application for the residence card.
4 - 5. Same as the answer before. You can get a job with your family permit if your family permit enables you to do so. The same with your residence card. In these cases it is not as important what YOU are doing, but what your SPONSOR (wife in this case) is doing.
6. Residence card decisions may take up to six months. People here in the forum have been getting it as quick as 4 months and some go over the six months, it will all depend on how solid your case is. By solid I mean, being able to prove your marriage is valid, that your wife is exercising treaty rights, that you won´t need benefits to get by, etc, etc.
I hope this helped out a bit, let me know if you have any other questions.
