I heard back on the 13th from pwc legal, its a no with 40 points.

It does not have to be on JobCentre , Employers can advertise on their own career website , In My case Job is advertise on my Employer's career website and my RLMT is completed.

Can anyone please explain what is the difference between salary calucated at 39 hours for RCoS
AND the "actual salary" payable for 37.5 hours/week which is advertised in the post?

I need to understand :
Is the salary calculated at 39 hours/week for the RCoS?
OR
Is the salary calculated at 37.5 hours/week for RCoS ( as it is advertised in the post )?

Hi all - on my second rejection now at 40 points, but my employer is keen to keep trying. We have one more shot in August before our RLMT expires. Does anyone know if there is anywhere where you can see what the figures were like at this time last year? The government website only goes back to early this year. Would just be interested to see if there was a definite trend in applications generally being higher and then reducing in August/September.

Also, if worst comes to worst and we have to redo the RLMT, when is it likely that the new salary thresholds will come into place for new cos applications - do you think they could start enforcing these from the September allocations on wards?

The new salary threshold coming in mid December the last time i read and will be enforced next year. I was trying to find the August figures for last year could not find it , I will try again and update you when I have any useful information.

Thanks for that. Sounds like we had similar ideas - I found on one of those internet archive sites the data for back to September 2014, but hoping to track down the April - August ones!

The minimum points for every month have always been 32 points, this is ridiculous.

Thanks for sharing this, Man the demand has never been this higher and Future never looked this uncertain.

I have read and done some analysis in this forum and looking at this data , i am speculating the cut off point 35. That is bold speculation but August can not be peak time , those who apply in August means starting work in November (as 11 August outcome of RCoS + 2-3 weeks visa process) and November start dates does not touch the peak that we are currently seeing. I do hope my speculations are right.

Section 28.17
28.17 You must place two advertisements using the methods set out in this guidance. In many cases, one of those will be an online advertisement using the Jobcentre Plus Universal Jobmatch service or Jobcentre Online for jobs in Northern Ireland. This is mandatory for certain jobs. For more information on advertisement methods, please see resident labour market test Tier 2 (General) advertising methods.

Section 28.19
28.19 All jobs must be advertised online to settled workers through the Jobcentre Plus Universal Jobmatch service (or for jobs based in Northern Ireland, JobCentre Online). The only exceptions to this rule are for:
  1. Creative sector jobs where the code of practice says that advertising is not needed because the migrant will be making an extra contribution to the UK labour market (see the creative sector codes of practice for more information). They can be found on our pages on the GOV.UK website at: http://www.gov.uk/government/collection ... f-practice.
  2. Milk round recruitment exercises.
  3. Pupillage positions for traine e barristers.
  4. Jobs which fall within the PhD level SOC codes. For more information, please see criteria.
  5. Jobs where the annual salary package will be £72,500 or more.
  6. Jobs where there will be stock exchange disclosure requirements
  7. Jobs in the NHS where the vacancy is advertised on the NHS Jobs website between 19 November 2012 and 6 April 2015.
  8. Jobs where the resident labour market test is not needed. For more information, please see exemptions from the resident labour market test.
Section 28.41 covers company's own website in only this case:
28.41 If you are a multi-national/global operation, or have over 250 employees in the UK, you can advertise the job on your own website.

Heard from my employer finally today and received my RCOS with 45 points after a rejection last month.

Hi,

Yesterday got call from my employer that my RCOS has been rejected due to high number of applications.
I have 40 points and they are going to apply again for August and hoping that I will get RCOS this time. :roll:

So congrats to all who got their!! Good luck to them who are going to re-apply (including me :) )

Hello,

I wanted to clarify one thing, is bonus is also a part of RCoS evaluation process or just the basic salary is counted? I am also waiting a reply regarding my RCoS from my employer. My salary is 30500 i.e. in total 40 points but if bonus is also counted it goes to 45 points.

I really wish all of us facing this unexpected problem get our RCoS approvals really soon.

Only guaranteed bonus is counted I think,

My employer is still not aware whether my application for RCOS has been approved or not which was submitted in July. Can you please let me know who will be notified, employer or the employee once the application is approved/rejected.

My point was 50 but still I have not received any confirmation from my employer. So if it has been rejected then how to know about the rejection reason.

I am bit confused as still I have not received any information.

the person (Usually employer/caseworker) who submit the application by online SMS management system gets notified by an email or by application status section of SMS management account.
