Rejected Tier 2 COS - Help!

Rejected Tier 2 COS - Help!

Hi all,

Long story short
- I currently have been in the UK on a YMS, just finishing up my last few weeks now
- My employer is more than happy to rehire me and ideally want to
- My employer has applied for the COS but has been denied, with no real reason provided other than my job is not on the shortage list and this may hurt me in terms of points
- I am headed back home (Canada) at the end of this month, also when my Visa ends... as planned. However, I won't know if I'm coming back depending on the status of my Visa

A few questions:

1) Is there any recommendations in terms of what to make sure of/stress in the application to assure the correct points are being attributed?
2) Does the threshold differ month to month? i.e. As a teacher, might the tough months be June, July, August... where as September, October, November might ease up a little bit?
3) If this Tier 2 Visa does not work out, are there any alternatives? Ideally, the UK is where I want to be, but this seems tough to make happen right now!

I appreciate your help, experts. This has been a draining and frustrating process. I apologize in advanced for any follow up questions.

Hi ED,

You said that the COS was denied saying it was not on the shortage list. Therefore I would assume your employer need to pass the RLMT before making an application for a COS. Unless you are qualified for Unrestricted COS allocation.

The threshold is the same for each month and only determined by how many points you have according to the Tier 2 sponsor guide on Gov.uk. However, note that in June, the RCoS was over subscribed and those below 50 points didn't pass. (meaning you could only get a RCoS in June if you are A.on shortage list. B. be a PhD. B. earn over 46,000 GBP annually.)

If Tier 2 doesn't work out, I am not sure if there is another way to work in the UK, but to my knowledge, you do need to be sponsored unless you are from EU.

I have read those policy papers but my answers might not be accurate. I would recommend you check with an immigration specialist.

Thank you so much for your reply! A few further questions:

- Aside from putting out the advertisement, what else qualifies for a "pass" on the RLMT? As far as I know, this was fine

- Speaking of which ^ - do different months provide a different "opening" I guess for applicants? As June was quite a bit, might it become a little easier in the months of July or August, are there any patterns that people may have noticed?

- I think my score was as high as a 38 - hoping that for the month of July I make it... but I'm not very optimistic.

Cant really comment on these as the employers and the legal teams know better.

I am afriad there are no different openings. The applications are judged by points only I think, well, based on Gov docs. We can't really predict what would be happenning. June is really abnormal so..let's hope July would be a bit easier.

Keep fingers crossed. I hope it gets back to 32. or Mac came up with some kind of policies to solve this.

Silly question - what's MAC and how might they change or influence the scoring and applicant system?

Another silly question - is there a limit to how many times you can apply? I'm seriously wondering when my employer might just want to cut their losses with me.

Rejected Tier 2 (June and July) - Reapplication Help!

Hi all, long bit short...

1. I was rejected in June and applied for July and was rejected then, as well.

2. With my rejection in July, it stated, and I don't know the proper wording, but to paraphrase - "This application will not be reconsidered." This is what was told to my employer and what my employer had told me.

3. Does this mean I can never reapply again?

4. I only scored about a 38, so I knew I wasn't going to get in for July, but who's to say I won't get a job that IS on the shortage list (I'm a teacher and I'm hoping to get qualifications in one of those shortage subjects) and eventually score 60+?

5. Might there be other reasons, other than points, why people might not get in under these terms?

Thanks again for the help, I look forward to people's responses... this site has been amazing.

'This application' means the application you submitted.

So you wanna be a Chemistry, Physics or Maths teacher? make sure you get your QTS verified...

You actually don't even need a specific qualification in any of these subjects, just an employer that is willing to hire you to teach one of them if you are already a qualified teacher. Again, I highly recommend ensuring that you have QTS...

So "This application" simply means that particular one, it doesn't mean that I can't reapply, correct?

Would there ever be a circumstance where someone can't reapply for a Tier 2?

Also, wouldn't my employer need to prove a case that there is a need in that subject and that I am capable of teaching it? I did pitch the idea of this to them before, but they simply said it was too risky.

COS Granted but with OLD Passport details...

Hi all,

This came up in another topic, but thought I'd give it it's own spotlight here and would love your help. In June, my employer applied for a RCOS for me to work there again. They did this with my old passport details, they didn't have my new passport details. With that said, a COS was granted and I was in the process of applying for my Visa appointment etc for the Tier 2.

Now, when I said to them that these were my old passport details on the COS sheet, they panicked and didn't think it would go through and that there would be problems. Since then, we've applied for June and July and have been rejected (with my new passport details) mainly because my score isn't high enough (I'm at a 38).

Would the old passport details have been an issue? Is it possible to still go through with it? Any tips here?
