U will have to repay it when they tell u, most likely of visa is granted at review then they will tell u to, and nothing she keeps passport with her until they ask for it (when visa is granted)

Hi,

I am glad to found out about this thread.

My 2nd wifes visa got refused 2nd time.

1st application details date of submitting the application 20 12 2013 got the reply after a long wait of 6 months on the 4th June 2014. Refused due to the reasons that I haven't provided my UK divorce certificate and I have provided a stamp paper issued to my from the Family courts in Pakistan stating my divorce from my previous wife. Well I have already applied in the Union Council for my divorce before getting married but never collected the Divorce certificate.

Well 2nd time Date of application submission 20th March 2015 well fortunate enough this time I have received the refusal on the 04th June 2015 round about the same date as the previous year.

This time my application was refused even I've included my Union Council divorce certificate and also included my UK divorce certificate I got my 2nd marriage done on the 14 09 2012 and my divorce got done in Pakistan on the 31 08 2012 I haven't collected the Nadra certificate and I have applied for it and paid the fee and got the certificate issued on the 1st Dec 2014 with a divorce date of 31 08 2012 which was pre dating my 2nd marriage and I have included in my application. In the mean time my X wife has applied another divorce from the UK courts as she wanted to get married here again and wanted to get a new visa which can only be possible through this way. I have received another my decree absolute dated 30th January 2015.

So the ILLITERATE LESS KNOWLEDGEABLE case worker refused my wifes visa by giving the reason that even my Pakistani divorce certificate is valid its not acceptable as I was not domiciled in Pakistan at the time of my divorce. Where as in the Chapter 8 FM Annex B acceptance of divorce clearly tells you about the acceptance of foreign divorce rules.

Well I have appealed now.

Date of Submission of Appeal 26th June 2015
Fees taken 07th July 2015
Don't know what's next now just waiting.

Is any one else in a similar boat as I am.

I no someone who was refused on the exact same issue and mashallah the decision was overturned at the review period. they just showed that they had the exact proof and won it. inshallah u will win at appeal too

Basically once u have lodged an appeal (within 28 days of when u get refusal) you get a confirmation that they have received it, then normally 1-3 weeks late payment is taken from your bank account (£80 paper hearing. £140 oral hearing) oral is best (in my opinion) as a lawyer can represent u and give your side in court whereas a paper hearing they go with just everything u have provided on paper.

Once payment has been taken it takes 4-6 weeks for an appeal notice to be sent out, this is sent to Islamabad embassy and yourself as well the lawyer (if u have one). On this appeal notice is a review deadline (15 weeks from appeal notice e.g i received mine 14th July and my deadline is 27th October) during the review period the ECO has the chance to re look at the papers with the new proof/supporting documents u have provided, this normally takes 4-8 weeks sometimes even less and if they are satisfied then decision is overturned and appeal is withdrawn and they call you to submit passport within 10 days.

however if review is not successful then they refuse and u have to wait for a court date which can be anything from 4-6 months

But I'm a sister not a brother haha anyways the person I know is just someone I used to speak to at a supermarket every time I went in, and we would give updates to each other I don't speak to them personally, but defo if u can go for appeal and win go for it, have u seeked any legal advice??

Don't worry inshallah all will be well, I appealed may 19th and I'm hoping for a decision mid/end of August time has flown by with Ramadan, eid, work and keeping busy with my son inshallah hope everyone is reunited, u should be looking at a decision around end of September, if u want an update u can call them on 0300 123 1711 and its option 4 they will ask for appeal reference if u don't have it just give applicants name and d.o.b and yours and they will also ask the business name of your lawyer, and they should be able to tell u if its in the queue or if its been sent out, I called 13th July they said its in the queue since the 2nd call back on the 15th and we will let u know what's happening and I called back and they said it was sent out on the 14th and I received it on the 16th.

I did tried contacting the no but for some stupid reason my lawyer/representative didn't put me as a authorized person and they want to speak to my wife only or my lawyer which is impossible as my wife is in Pakistan don't know what shall I do ?? I'll contact my lawyer to write a letter to them and give me the authorization to make enquiry about the progress of my appeal.

Somebody said yesterday that the courts are working on april/may appeals

Do u think thats based on issue of notice date or the date u lodged ur appeal.

I lodged mine on 30th april but received notice 23rd june

from appeal date i think, the latest appeal i heard from is like end of april, it also depends what number in queue etc and when it was sent off, were from what date loads of factors.

Yes.

What did your solicitor say about the refusal? Clearly she was at fault.
TIMELINE

Spouse Visa (Entry Clearance) granted on 20-02-15
FLR-M (Extension) granted on 24-08-17
ILR (SET-M) not due until 2020

Not many people are updating their information here on the forum regarding the appeal time line.

well I've submitted mine on the 26th June 2015 and the fee was taken on the 07th July 2015 for an Oral hearing of £140.00.

Now I don't know what's going on I have contacted my lawyer as well and he also haven't got any information available to him regarding my wifes visa appeal case.

does any one have emailed them before and got any reply.

please I would like to request every one to kindly update their appeal time line on this thread its quite useful for every one to determine how long actually an appeal is taking to complete.

I don't know how long more do I have to wait its been almost 3 years now already long enough time that I am in the middle of no where applied twice got refused and now this appeal is also taking ages. Some times I just feel that I just say bye to this country and go back to Pakistan and start my family life over there, as all this visa hassle is the biggest stress of my life and extremely frustrating as well and the cost its just phenomenal have lost the count how much I've spent so far just on that process most of the money is gone wasted my hard earned earnings gone wasted as well.

Don't do one now, when appeal has been overturned then do it as its only valid for 6 months, so if u do it not it may expire if the appeal is not successful and it goes to court (inshallah it wont get 2 that) so a waste of money, my Hubby's expired July 3rd appealed 19th may, he will redo it once he gets call for visa etc inshallah

Not many people are updating their information here on the forum regarding the appeal time line.

well I've submitted mine on the 26th June 2015 and the fee was taken on the 07th July 2015 for an Oral hearing of £140.00.

Now I don't know what's going on I have contacted my lawyer as well and he also haven't got any information available to him regarding my wifes visa appeal case.

does any one have emailed them before and got any reply.

please I would like to request every one to kindly update their appeal time line on this thread its quite useful for every one to determine how long actually an appeal is taking to complete.

I don't know how long more do I have to wait its been almost 3 years now already long enough time that I am in the middle of no where applied twice got refused and now this appeal is also taking ages. Some times I just feel that I just say bye to this country and go back to Pakistan and start my family life over there, as all this visa hassle is the biggest stress of my life and extremely frustrating as well and the cost its just phenomenal have lost the count how much I've spent so far just on that process most of the money is gone wasted my hard earned earnings gone wasted as well.

Dont worry I know how stressful it is! I have a 18 month old son and have been married 2013, I have to say also it is one of the hardest things ever I have experienced but think of it like this one day all this will be over and u will be able to relax and enjoy life, just hold on a little bit more, majority of time has passed
